This Criminal Appeal is filed by the appellant-accused No.4 seeking to set aside the order dated 29.06.2026 passed in Crl.M.P.No.147 of 2026 in Crime No.98 of 2026 by the Special Sessions Judge for Trial of Cases under SC/ST (POA) Act-Cum-II Additional Sessions Judge, Warangal and further seeking to enlarge the appellant-accused No.4 on bail.

2. Heard Sri Mohammed Saddam, learned counsel for the appellant-accused No.4 and Sri E. Ganesh, learned Additional Public Prosecutor, appearing for the respondent- State.

3. Learned counsel for the appellant submitted that the appellant had filed a bail application before the trial Court, as he is involved in offences under Sections 103(1), 140, 61(2)(A), and 238(A) read with Section 3(5) of the BNS and Section 3(2)(V) of the SC/ST (POA) Act, wherein the trial Court, considering the gravity of the allegations, dismissed the petition. He further submitted that the appellant has been falsely implicated in this crime and has been in judicial custody since 18.04.2026. Even after three months, no charge sheet has been filed by the Investigating Officer. As such, learned counsel requested the Court to grant bail to the appellant.

4. On the other hand, the learned Additional Public Prosecutor opposed the bail petition, contending that there is no illegality in the order of the trial Court and that the trial Court rightly dismissed the petition, as the allegations against the appellant are severe and grievous in nature. However, he informed the Court that the investigation is not yet completed and no charge sheet has been filed. Hence, he prayed that the Court dismiss the appeal.

5. Considering the submissions made by the learned counsel for both parties and upon perusal of the material on record, the appellant has been in judicial custody since 18.04.2026. Even according to the learned Public Prosecutor, no charge sheet has been filed even after the expiry of 90 days. Considering the facts and circumstances of the case and the duration of the appellant's incarceration in judicial custody, this Court deems it fit to grant regular bail to the appellant/Accused No.4, subject to the following conditions:

(i) The appellant-Accused No.4 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate at Parkal.

(ii) On such release, the appellant-accused No.4 shall appear before the concerned SHO at 11:00 a.m. and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The appellant-Accused No.4 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

6. Accordingly, the Criminal Appeal is allowed.

Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 20.07.2026 FM
