ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused Nos.1 to 6 in Crime No.108 of 2026 before the Kalpattar Police Station, Hyderabad, registered for the offence punishable under Sections 331, 305(a) r/w 3(5) of BNS.

SKS,J Crl.P.No.10533 of 2026

2. The brief facts of the case are that the petitioners/accusedNos.1 to 6 were arrested in Crime No.108 of 2026 of Kalapathar Police Station for the offences punishable under Sections 331 and 305(a) of the BNS, on the allegation of committing theft of about Rs.60,00,000/- from KGN Poultry Traders after breaking open the shop and cupboard.

3. Heard Sri K. Venumadhav, learned counsel appearing on behalf of the petitioners, as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

4. Learned counsel for the petitioners submitted that the petitioners have been falsely implicated and there are no specific allegations against them either in the complaint or the CCTV footage, which only shows an unknown person committing the theft. He further submitted that the petitioners were illegally detained, implicated only after a Habeas Corpus petition was filed, police custody has already been completed, the investigation is substantially over, they have been in judicial custody since 11.06.2026, and are ready

to abide by any conditions. Therefore, he prayed the Court to grant bail to the petitioners by allowing this Criminal Petition.

5. On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that during the course of investigation, sufficient material was collected connecting the petitioners with the commission of the offence and the investigation is still in progress. Further, the investigation is not yet completed. At this stage, granting of bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

6. In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the allegation against the petitioners is that they committed theft of Rs.60,00,000/- by breaking open the shutter and cupboard of KGN Poultry Traders and were involved in the commission of the offence pursuant to the investigation conducted by the police. The investigation has collected prima facie material connecting the petitioners with the crime and the investigation is not yet complete. Further, other criminal cases are pending against the petitioners.

SKS,J Crl.P.No.10533 of 2026

Therefore, this Court is not inclined to grant bail to the petitioners. However, petitioner No.5, being a woman this Court deems it fit to grant bail to her, subject to the following conditions: i. The petitioner No.5 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Special Judicial Magistrate of First Class for Excise Cases, Hyderabad. ii. The petitioner No.5 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner No.5 shall abide by the conditions stipulated in Section 437(3)

of Cr.P.C.(presently, Section 480(3) of the BNSS).

7. Accordingly, the Criminal petition is allowed in part. However, the petition filed against petitioner Nos.1 to 4 and 6 is dismissed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 17.07.2026 SAI
