This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/accused No.2 seeking to enlarge him on bail in connection with Crime No.224 of 2026 of Osmania University Police Station, Hyderabad. The offences alleged against the petitioner are punishable under Sections 64
(2) (m), 87, 127 (3), 308 (2), 351 (2), 140 (3) read with 3 (5) of the BNS.

2. The case of the prosecution is that the complainant lodged a complaint before police on 08.05.2026, wherein it is stated that accused No.1 used to contact her through messages and calls from his Instagram ID and he proposed her. However, she came to know that he is a married person and having three children, she did not accept or encourage his proposal. Despite that, he frequently called to her and insisted to love him and forcibly kidnapped her with the help of petitioner-accused No.2. It is stated that accused No.1 also beat her to give false statement that she voluntarily came along with him. Thereafter on 11.04.2026, when the Osmania University Police came, the accused No.1 threatened and frightened her and made her to give a statement that she had gone along with him voluntarily. Whenever accused No.1 went outside, he used to lock her in the room from outside and he would accompany him whenever she went outside. Hence, she requested the police to take necessary action against the petitioner. Basing on the same, police registered a case for the aforesaid offences. According to the prosecution, the only offence attract to the petitioner is only Section 140 (3) of the BNS.

3. Heard Sri Mohammed Ghouse Pasha, learned counsel for the petitioner/accused No.2 and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.
4. The contention of learned counsel for the petitioner is that the petitioner-accused No.2 is innocent of the offences alleged against him and he has been falsely implicated in this case; that there are no grave allegations against the petitioner, except he accompanied with accused No.1; that the petitioner has been in judicial custody from 15.05.2026; that material part of the investigation is completed, as such requested this Court to grant bail to the petitioner.
5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioner are serious in nature; that the investigation is not yet completed; that medical evidence shows that the victim is pregnant, therefore, at this stage, the petitioner is not entitled for grant of bail and hence, he prays to dismiss the petition.

6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the allegations in the complaint would attract only the offence under Section 140 (3) of the BNS and other offences prima facie are not attracted as he only accompanied with accused No.1 for kidnapping the victim. As seen from the record, L.Ws.1 to 24 were examined. Considering the nature of allegations, period of incarceration and progress in investigation, this Court is inclined to grant bail to the petitioner-accused No.2 subject to the following conditions:
(i) The petitioner-accused No.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties for a like sum each to the satisfaction of the learned IV Additional Chief Judicial Magistrate, Nampally, Hyderabad.
(ii) On such release, the petitioner-accused No.2 shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
(iii) The petitioner-accused No.2 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).
7. Accordingly, the Criminal petition is allowed.
