ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1

in Crime No.541 of 2026 before the Bachupally Police Station, Cyberabad District, registered for the offence punishable under Sections 316(2), 318(4), 335(c), 336(3) and 338 r/w. 3(5) of BNS.

2. The brief facts of the case are that the de facto complainant lodged a report before the Police stating that he got acquainted with the petitioner in the year 2024 and as he had financial constraints due to marriage of his daughter, he agreed for a deal with the petitioner by mortgaging the property. However, later the complainant came to know that unlawfully the petitioner has taken his signatures over the sale deed in favour of other person and has cheated him which resulted in loss of his property. Thereafter, the police registered case against the petitioner for the alleged offences.

3. Heard Sri R.Mangulal, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent – State.

4. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences as alleged and instead of filing civil suit, the petitioner was falsely implicated in criminal case. He averred that petitioner was remanded to judicial custody on 19.06.2026 and material part of the investigation is already complete. He lamented that though two other cases were registered against the petitioner, the petitioner was released on bail in both the cases. While asserting that petitioner is innocent of the offences, he prayed to enlarge the petitioner on bail.

5. Learned Additional Public Prosecutor appearing for respondent No.1–State, opposed the submissions made by learned counsel for the petitioner and contended that there are serious allegations of financial fraud against the petitioner. He averred that petitioner took the signatures of complainant in an unlawful manner due to which the complainant lost his property. Therefore, he prayed for dismissal of the petition.

6. Having regard to the rival submissions made, and on perusing the material placed on record, it is noted that the petitioner is in jail from 19.06.2026. That apart, LWs.1 to 8 are already examined. As such, considering the facts of the case, the nature of allegations, the period of incarceration of the petitioner, and the fact that further investigation can be based on documentary evidence, this Court is of the opinion that it is a fit case to grant bail to the petitioner, subject to the compliance of following conditions:'

i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the PJCJ Cum XI Additional Judicial Magistrate of First Class, MM District, at Kukatpally.

ii. The petitioner shall appear before the concerned SHO at 11:00 a.m. on every Monday for a period of eight (8) weeks or till filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently Section 480(3) of the BNSS).

7. Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 16.07.2026 PT
