ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1

in Crime No.558 of 2026 before the Dundigal Police Station, registered for the offence punishable under Section 69 of BNS.

2. The brief facts of the case are that the de facto complainant and the petitioner were acquainted with each other for about eight months prior to the registration of the crime and were in contact through social media. It is alleged that the petitioner, on the promise of marriage, developed a relationship with the de facto complainant and had physical intimacy with her on multiple occasions. Subsequently, disputes arose between them, and upon the complainant insisting on marriage, the present complaint came to be lodged on 01.06.2026, which was registered as Crime No.558 of 2026. The petitioner was arrested on 18.06.2026 and remanded to judicial custody on 19.06.2026.

3. Heard Sri M. Keshav Yadav, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent No.1 – State.

4. Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the present case. It is contended that the material on record itself discloses a consensual relationship between the petitioner and the de facto complainant spanning several months and that the allegations arose only after a dispute between them. It is further submitted that the investigation is substantially completed, material witnesses have already been examined, and the petitioner has been in judicial custody since 19.06.2026. Therefore, he prayed to enlarge the petitioner on bail.

5. Learned Additional Public Prosecutor appearing for respondent No.1–State, opposed the submissions made by learned counsel for the petitioner and contended that the allegations against the petitioner are serious in nature and that the investigation is still pending in certain aspects. It is further contended that if the petitioner is released on bail, there is every likelihood of influencing the witnesses or tampering with the evidence. Therefore, he prayed for dismissal of the petition.

6. Having regard to the rival submissions made, and on perusing the material placed on record, it is noted that the petitioner is in jail from 19.06.2026. That apart, LWs.1 to 17 are already examined. As such, considering the facts of the case, the nature of allegations, and the period of incarceration of the petitioner, this Court is of the opinion that it is a fit case to grant bail to the petitioner, subject to the compliance of following conditions:'

i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the VIII Additional Judicial First Class Magistrate, at Medchal.

ii. The petitioner shall appear before the concerned SHO at 11:00 a.m. on every Monday for a period of eight (8) weeks or till filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently Section 480(3) of the BNSS).

7. Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 16.07.2026 PT
