ORDER
This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.125 of 2026 before the Gadwal Town Police Station, Jogulamba Gadwal District, registered for the offence punishable under Sections 137(2), 64(2)(m) of BNS and Section 5(1) read with 6 of POCSO Act.
SKS,J Crl.P.No.10221 of 2026
2. The brief facts of the case are that on 28.05.2026, the complainant (mother of the minor victim girl) reported that her 16-year-old daughter, who had gone for tailoring classes on 27.05.2026, did not return home. The complainant suspected the petitioner/accused, G. Parusharamulu @ Pitta, in connection with her daughter’s disappearance. Based on this, FIR in Crime No. 125/2026 was registered at Gadwal Town Police Station for the offence under Section 137(2) of the BNS. Subsequently, during the investigation, the victim was recovered from Hyderabad on 29.05.2026, and based on the findings, Sections 64(2)(m) BNS and Section 5(1) r/w 6 of the POCSO Act, 2012 were added. The petitioner was arrested on 01.06.2026 and has been in judicial custody since then. The investigation is completed and the charge sheet has been filed.
3. Heard Sri S. Bhaskar, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent – State.
4. Learned counsel for the petitioner submitted that the allegations are false and the petitioner has been implicated due to village factions and caste animosities. The relationship

between the petitioner and the victim was consensual and based on mutual affection, as admitted by the victim in her statement under Section 180(3) BNSS. The investigation is completed and the charge sheet has been filed, so there is no possibility of tampering with evidence. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.
5. On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the offences are grave and serious in nature, involving aggravated penetrative sexual assault on a minor girl under the POCSO Act. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.
6. In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 01.06.2026. As seen from the record, the material part of the investigation has been completed and charge sheet is also filed. Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:
SKS,J Crl.P.No.10221 of 2026
i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the I Additional Judicial Magistrate of First Class, Gadwal. ii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).
7. Accordingly, the Criminal petition is allowed.
Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 15.07.2026 SAI
