This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/Accused No.2 seeking to enlarge him on bail in connection with Crime No.84 of 2026 of Narayankhed Police Station, Sangareddy District. The offences alleged against the petitioner are punishable under Sections 305(b), 111 of the BNS, Section 25 (1), (11A) of the Arms Act, 1959.

2. The case of the prosecution is that the de facto complainant lodged a report before police on 11.04.2026,

wherein it is stated that his DCM vehicle was stolen by unknown offenders. It is stated that the accused persons are members of organized gang. It is stated that the petitioner along with other accused committed theft of DCM vehicle, as such requested the police to take necessary action on the complaint. Basing on the same, police registered a case for the aforesaid offences.

3. Heard Sri CDSB Venkata Rao, learned counsel for the petitioner/Accused No.2 and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent- State.

4. The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him; that he has been in judicial custody since 04.05.2026; that material part of the investigation is completed; that prima facie the allegations in the complaint do attract the ingredients of offence under Section 350 (b) of the BNS and hence, he prays this Court to grant regular bail to the petitioner.

5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the petitioner

is a habitual offender. Apart from this crime, the petitioner is also involved in NDPS Act in the year 2017. He further submits that after commission of present crime, the petitioner along with other accused proceeded to Maharastra State to commit the offence, as such the petitioner is not entitled for grant of bail. However, he submits that no charge sheet is filed as on today.

6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 04.05.2026. As seen from the record, L.Ws.1 to 10 were examined. Prima facie, the allegations in the complaint does not attract the ingredients of Section 305 (b) of the BNS and so also offence under Section 29 (b) of the NDPS Act was committed by him in the year 2017. Hence, considering the period of incarceration and progress in investigation, this Court is inclined to grant bail to the petitioner-accused No.2 subject to the following conditions:

(i) The petitioner-accused No.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Narayankhed.

(ii) On such release, the petitioner-accused No.2 shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioners-accused No.2 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 14.07.2026 YVL
