This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/JCL seeking to enlarge him on bail in connection with Crime No.133 of 2026 of Talakondapally Police Station, Ranga Reddy District. The offences alleged against the petitioner are punishable under Sections 137 (2), 64 (1) of the BNS; Section 3 read with 4 of the Protection of Children from Sexual Offences Act, 2012.

2. The case of the prosecution is that the parents of the victim came to the police station and lodged a report on 08.06.2026, wherein it is stated that they are having

daughter, aged about 17 years. On the date of incident, they went to their agricultural field leaving their daughter alone at home. They returned home at about 12:00 Noon for lunch and found the victim at home. Thereafter, they went to the fields and returned home at about 2:00 PM. At that time they found that their daughter-victim was missing from the house. They searched for her and enquired about her in the locality. But, they did not found her. The complainant suspects that one Siddhartha, residence of their Thanda i.e., the petitioner herein is responsible for missing of her daughter. Hence, they approached police and lodged the aforesaid complaint. Basing on the same, initially police registered a case under ‘woman missing’ and on further investigation police added the Section of law. It is further stated that the petitioner induced the victim and took her under the promise of marriage and thereby committed the offence under Section 3 read with 4 of the POCSO Act.

3. Heard Sri S.Mahesh, learned counsel for the petitioner/JCL and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

4. The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him and he is aged about 16 years old and studying Intermediate. He further submits that entire investigation is completed and the petitioner has been in judicial custody from 11.06.2026; that if the petitioner is not released on bail, his studies will be affected and hence, he prays this Court to grant regular bail to the petitioner.

5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioner are serious and heinous in nature; that the investigation is not yet completed. He further submits that statement of the victim under Section 183 of the BNSS was not yet record and a requisition was sent on 18.06.2026 and it is pending and hence, he prays this Court to dismiss the petition.

6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 11.06.2026. Even according to the prosecution case, the petitioner herein and victim are aged about 16 years old.

(ii) On such release, the petitioner-JCL shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner-JCL shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 14.07.2026 YVL
