ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.387 of 2026 before the Madhura Nagar Police Station, Hyderabad, registered for the offences punishable under Sections 75, 78, 79 and 296 of BNS.

2. The brief facts of the case are that, on 04.06.2026, the de- facto complainant lodged a report before the police stating that, on 24.05.2026, when she was returning home from work, the petitioner herein followed her. He continued to follow her until she reached the end of a street where there were no people present in the vicinity. While following her, the petitioner herein intentionally behaved in an obscene and indecent manner and harassed her. He also abused her using vulgar and offensive language, causing her fear, mental distress, and humiliation. The entire incident was captured on CCTV cameras installed in the area and she has submitted the said CCTV footage to the Investigating Officer. Hence, she requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

3. Heard Sri Vijay Kumar Panuganti, learned counsel for the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

4. Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and he is falsely implicated in the present case and he is in jail since 05.06.2026. He further submitted that the entire investigation was already completed and the vehicle was already seized and the custodial interrogation of the petitioner is not required for further investigation. He further submitted that there is a delay in lodging the report, though the alleged incident was occurred on 24.05.2026, the same was reported on 04.06.2026 and no such explanation for the delay was given in the complaint or in the FIR. Therefore, he prayed to grant bail.

5. On the other hand, the learned Additional Public Prosecutor opposed the submissions stating that there are serious allegations against the petitioner and the investigation is not yet completed. Hence, at this stage, grant of bail is not warranted and the petition is liable to be dismissed.

6. In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 05.06.2026 and the record shows that the alleged incident was occurred on 24.05.2026 and the same was reported on 04.06.2026 and there is no such explanation for the delay in lodging the report. Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned X Additional Sessions Judge, at Hyderabad. ii. The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 14.07.2026 TU
