2. The case of the prosecution is that the complainant lodged a report before police on 26.05.2026, wherein it is stated that when she was studying Intermediate she got acquaintance with the petitioner and they became close to each other and the petitioner told that he would marry her after she completed her studies and settled in life. It is stated that in the month of January 2018 while the complainant was going to her house, the petitioner wanted to drop her at the bus stand and as buses were not there, he suggested her to sleep for that night in the clinic of his friend. Taking advantage of the same, the petitioner and complainant were in physical relationship. While the complainant was prosecuting her MBBS, the wife of the petitioner came to know about their relationship, downloaded their personal photos from the mobile of petitioner and sent them to her mobile and in that connection quarrel took place among three of them. It is stated that after completion of her MBBS her parents were searching for matches for her, but the petitioner and his wife to defame her, shared her photos with prospective bridegrooms and their family and harassing her. Hence, she requested the police to take necessary action on

the said complaint. Basing on the same, police registered a case against the petitioner for the aforesaid offences.

3. Heard Sri Nadipally Ananda Rao, learned counsel for the petitioner/accused No.1 and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

4. The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him; that knowingly the petitioner is already a married person, the complainant continued the physical relationship with him and when the same was known to his wife, the wife of the petitioner and petitioner sent the photos to the brother of the complainant, as such the complainant falsely implicated the petitioner in this case; that entire investigation is completed; that the petitioner has been in judicial custody since 18.06.2026 and hence, he prays this Court to grant regular bail to the petitioner.

5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence committed by the petitioner is serious and heinous in nature; that the petitioner has committed rape on the minor girl in

the year 2018. He submits that notice is already served on the victim; that investigation is not yet completed and hence, he prays this Court to dismiss the petition.

6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 18.06.2026. As seen from the record, L.Ws.1 to 17 were examined and statement of the victim under Section 183 of the BNSS was already recorded. Considering the nature of allegations and period of incarceration, this Court is inclined to grant bail to the petitioner-accused No.1 subject to the following conditions:

(i) The petitioner-accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned Fast Track Special Court for Expeditious Trial and Disposal of Rape and Protection of Children against Sexual Offences (POCSO) Act Cases at Jangaon (Principal District and Sessions Judge (POCSO) Court at Jangaon).

(ii) On such release, the petitioner-accused No.1 shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner-accused No.1 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 14.07.2026 YVL
