ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.829 of 2025 before the Nagole Police Station, Rachakonda Commissionerate, registered for the offences punishable under

Sections 316(5), 318(4) r/w 3(5) of BNS and Sections 3 and 5 of the TS Depositors Finance Establishment Act, 1999.

2. The brief facts of the case are that, on 10.03.2026, the de- facto complainant lodged a report before the police stating that the petitioner herein along with other accused promoted investment schemes promising returns of 10% to 16% on investment and the victims have invested huge amounts in the said schemes and the victims/investors transferred funds through bank transfers believing the schemes to be genuine and the petitioner along with other accused misused the said funds and they have not paid any amount to the victims. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

3. Heard Sri M. Prudhvi Raju, learned counsel for the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent–State.

4. Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and he is falsely implicated in the present case and he is in jail since 01.04.2026. He further submitted that, even after completion of the entire investigation, no charge sheet is filed. Therefore, he prayed to grant bail.

5. On the other hand, the learned Additional Public Prosecutor opposed the submissions stating that there are serious allegations against the petitioner and it is a huge financial fraud and the investigation is not yet completed. Hence, at this stage, grant of bail is not warranted and the petition is liable to be dismissed.

6. In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 01.04.2026 and as seen from the record, as on today, no charge sheet is filed even after lapse of 90 days. Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only, with two sureties for a like sum each to the satisfaction of the learned I Additional

District and Sessions Judge, Ranga Reddy District, at L. B. Nagar. ii. The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 14.07.2026 TU
