02. Heard Sri S. Ravi Kiran Reddy, learned counsel for the petitioner, Sri K.Sharath, learned Assistant Government Pleader for Higher Education appearing for the respondent No 1 and Sri Prabhakar Peri, learned Standing Counsel for Jawaharlal Nehru Technological University Hyderabad (JNTIJH), appearing for the respondent No.2. Even after service of notice, none appeared on behalf of the respondent No.3.

03. Learned counsel for the petitioner sucmitted that, at the time of admission into the B.Tech. (Civil Engineering) course in the respondent No.3-College, the petitioner had deposited all his original academic certificates and documents, including the SSC Certificate, lntermediate Marks Memos, Transfer Certificate, Study Certificates and other relevant documents required for admission. lt is submitted that the Management of respondent No.3-College retained the said original certificates and, despite the petitioner having successfully completed the course and cleared all the legitimate dues payable to the College, has failed and refused to return the same. Learned c;ounsel further submitted that no amount whatsoever is due from the petitioner to the respondent No.3-College.

04. Learned counsel further submitted that the petitioner requires the original certificates for securing employment and earning his livelihood, and that the continued retention of the said certificates by respondent No.3-College has caused serious prejudice to the petitioner's career prospects. lt is contended that the action of respondent No.3-College tn withholding the petitioner's original academic certificates, which were deposited at the time of admission, is wholly illegal, arbitrary, and without any authority of law. Therefore, he prayed to issue an appropriate direction to the respondent No.3-College to forthwith return all the original certificates and documents belonging to the petitioner.

05. Perused the record.

06. lt is not in dispute that the original certificates of the petitioner referred to above were submitted before the respondent No.3-college at the time of admission and the petitioner had completed his B.Tech course from the respondent No.3-college. The said certificates, being personal and academic credentials, are undoubtedly the property of the petitioner. ln such circumstances, the respondent No.3-college has no authority whatsoever to retain the said certiflcates and the retention of the RlEt', petitioner's original certiflcates by the respondent No.3-college is wholly unjustified and cannot be sustained. Even assuming that the college has any monetary claim against the petitioner, withholding his original certificates cannot be adopted as a mode of enforcing such claim, the proper remedy, if any available to the college is to proceed in accordance with law forecovery of its dues, but not retain the petitioner's original certificates.

07. Accordingly, the Writ Petition is allowed. The respondent No.3-College is directed to return all the original academic certificates and other original documents of the petitioner, deposited at the time of admission, within a period of one (01) week from the date of receipt of a copy of this Order' There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed SD/. A.H.S.GOWRI SHANKAR ASSlSTANT REGISTRAR //TRUE COPY//
