ORDER

This Criminal Petition is filed challenging the order dated 15.06.2026 passed in Crl.M.P.No.912 of 2026 in S.C.Spl.No.734 of 2020 by the learned Fast Track Special Judge for Trial and Disposal of Rape and POCSO Act Cases, Ranga Reddy District at L.B. Nagar.

SKS,J Crl.P.No.9850 of 2026

2. Heard Smt. P. Radhika, learned counsel appearing for the petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

3. Learned counsel for the petitioner submitted that the petitioner has been regularly appearing before the trial Court on every date of hearing, except on 05.06.2026, when he could not appear. She further submitted that the trial has almost been completed and the matter is now posted for the cross- examination of the Investigating Officer. In the meantime, the petitioner filed a petition to recall P.Ws.1 to 4 for cross- examination, and the same was allowed by the trial Court. She contended that unless the petitioner is enlarged on bail, he would not be in a position to properly instruct his counsel for the effective cross-examination of P.Ws.1 to 4. Therefore, she prayed that this Criminal Petition be allowed and the petitioner be enlarged on bail.

4. On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that there are serious allegations against the petitioner. He further submitted that the delay in the trial is attributable to the petitioner.

SKS,J Crl.P.No.9850 of 2026

According to him, if the petitioner is enlarged on bail, there is every likelihood of his absconding and not cooperating with the trial. Therefore, he submitted that this is not a fit case for grant of bail and prayed that the Criminal Petition be dismissed.

5. In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner remained absent before the trial Court only on one occasion. It is also evident that the prosecution evidence has already been completed and the case is now at the stage of cross-examination of P.Ws.1 to 4, who have been recalled. Considering the stage of the trial and the facts and circumstances of the case, this Court deems it appropriate to enlarge the petitioner on bail, subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Fast Track Special Judge for Trial and Disposal of Rape and POCSO Act

SKS,J Crl.P.No.9850 of 2026

Cases, Ranga Reddy District at L.B. Nagar. ii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS). iii. The petitioner is directed to co-operate with the trial for the early disposal of the case.

6. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 10.07.2026 SAI
