This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.91 of of Kondapur Police Station, Sangareddy District, registered for the offences punishable under Sections 137(2), 65(1) of the BNS, Section 5 (I) r/w 6 of the POCSO Act, 2012 and Section 9 of the PCM Act, 2006.

2. The case of the prosecution is that, on 02.05.2026, the de-facto complainant, who is the mother of the victim, lodged a report before the police stating that her daughter is aged about

16 years. On 01.05.2026, as usual, the complainant and her husband, left the house for work, while their daughter remained at home. The complainant returned home at about 19:00 hours, but did not found her daughter at the house. Thereafter, the complainant and her family members searched for her in the surrounding areas and enquired with friends and relatives about her whereabouts, but she could not be traced. Hence, the complainant requested to take necessary action and also they suspected the petitioner herein is responsible for the missing of their daughter. Basing on the said complaint, initially the police registered a case for the offence punishable under Section 137(2) of the BNS and later, basing on the statement of the victim, the section of law was altered to the above said offences.

3. Heard Sri Bhukya Srinivas Nayak, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent.

4. Learned counsel for the petitioner submitted that the petitioner herein is innocent of the said allegations and he is falsely implicated in the present case. He further submitted that the petitioner is in jail since 13.05.2026 and the statement of the victim clearly shows that she herself went along with the petitioner and they are in love for the past several years and the petitioner herein has already performed marriage with the victim, as such, there is no such offence committed by the petitioner herein and the entire investigation was already completed and the charge sheet is already filed. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

5. On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner are serious and heinous in nature. He further submitted that the alleged consent of the victim cannot be taken as a ground for granting bail, particularly when the victim is a minor below the age of 18 years. He further submitted that the investigation has been completed and the charge sheet has already been filed on 24.06.2026, as such, the petitioner is not entitled to be enlarged on bail. Therefore, he prayed for dismissal of the Criminal Petition.

6. Having considered the submissions made by both sides and upon perusal of the material available on record, it is evident that the petitioner has been in judicial custody since 13.05.2026 and as seen from the record, the statement of the victim under Section 183 of the BNSS was already recorded.

According to the victim, she went along with the petitioner herein and married the petitioner. Further, the entire investigation was already completed and the charge sheet was already filed on 24.06.2026. Considering the facts and circumstances of the case, the nature of the allegations, the completion of investigation, the period of incarceration of the petitioner, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned I Additional Judicial Magistrate of First Class, at Sangareddy. ii. On such release, the petitioner shall appear before the Court concerned on each and every date of hearing till conclusion of the trial in the aforesaid Case. iii. The petitioner shall abide by the conditions stipulated in Section 437(3)

of Cr.P.C. (presently, Section 480(3) of the BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed. _______________ K. SUJANA, J Date: 09.07.2026 TU
