This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/Accused seeking to enlarge him on bail in connection with Crime No.258 of 2026 of Nacharam Police Station, Malkajgiri. The offences alleged against the petitioner are punishable under Sections 69 of the BNS and Section 3 (2) (v) of the SCs & STs (POA) Amendment Act, 2015.

2. The case of the prosecution is that the victim lodged a complaint before police on 24.05.2026, wherein it

is stated that 6 years ago, the petitioner expressed love to her sister who is the victim herein. Under promise of marriage, the petitioner exploited victim sexually. It is stated that two months ago, he intended to marry another woman. When the victim questioned the petitioner, he expressed that he is not interested to marry due to difference in caste and he gave evasive replies. As he refused to marry her, on 22.05.2026 the victim consumed 20 thyroid tables and attempted to commit suicide. She came unconscious and shifted to hospital. Hence, she requested the police to take necessary action on the complaint. Basing on the same, police registered a case for the aforesaid offences.

3. Heard Ms.K.Saipriya, learned counsel for the petitioner/Accused and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent- State.

4. The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him; that whatever relationship between the parties is a consensual one; that the petitioner never refused to marry the victim on the ground of caste even

today the petitioner is ready to marry her. Further, the petitioner is in judicial custody from 03.06.2026; that material part of the investigation is completed; that he is the sole bread winner of the family and hence, he prays this Court to grant regular bail to the petitioner.

5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioner are heinous and non-production of caste of victim, he refused to marry the victim and he is physically exploited her for the last six years, therefore, the petitioner is not entitled for bail and hence, he prays to dismiss the petition.

6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 03.06.2026. As seen from the record, L.Ws.1 to 11 were examined. Considering the period of incarceration, nature of allegation and progress in investigation, this Court is inclined to grant bail to the petitioner-accused subject to the following conditions:

(i) The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like

sum each to the satisfaction of the learned I Additional Junior Civil Judge-cum-V Additional Judicial Magistrate of First Class, Uppal at Medipally, Medchal, Malkajgiri District.

(iii) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 09.07.2026 YVL
