This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/Accused seeking to enlarge him on bail in connection with Crime No.683 of 2026 of Miyapur Police Station, Miyapur-Cyberabad. The offence alleged against the petitioner is punishable under Section 69 of the BNS.

2. The case of the prosecution is that on 02.05.2026 the de facto complainant lodged a report before police, wherein she stated that the petitioner known to her for the past five years as they were met at Global IT Flyer IT solutions. It is stated that she was aware of petitioner’s

mutual divorce proceedings and he promised that he would marry her once she obtained divorce. Based on his promise, the victim entered into physical relationship with him. It is stated that the petitioner had no intention to marry her and with a false promise of marriage he exploited her by misleading her by hiding his true identity and type of employment. Hence, she requested the police to take necessary action against the complaint. Basing on the same, police registered a case against the petitioner for the aforesaid offence.

3. Heard Smt.C.Vasundhara Reddy, learned counsel for the petitioner/Accused and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

4. The contention of learned counsel for the petitioner is that the petitioner is innocent of the offence alleged against him and he has been falsely implicated in this case and there is no such incident had occurred as alleged by the complainant; that whatever relationship between the parties is voluntary in nature and it is a consensual relationship; that as on the date of entering into the relationship, the complainant is married person and due to disputes she has been living separately with her

husband; that a false complaint has been lodged against the petitioner; that material part of the investigation is completed, as such requested this Court to grant regular bail to the petitioner.

5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence alleged against the petitioner is serious in nature and that investigation is not yet completed. The complainant is present in-person before this Court and objected for grant of bail to the petitioner on the ground that though the petitioner is in judicial custody, the third parties are threatening her stating that they will post the photos in social media that if the petitioner released on bail there is threat to her life and hence, she prays this Court to dismiss the petition.

6. Considering the submissions made by learned counsel for petitioner, learned Additional Public Prosecutor, and the complainant, the petitioner has been in judicial custody since 02.06.2026. As seen from the record, material part of the investigation is already completed; L.Ws.1 to 14 were examined. Considering the period of incarceration, nature of allegation and progress in

investigation, this Court is inclined to grant bail to the petitioner-accused subject to the following conditions:

(i) The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned VIII Additional Judicial Magistrate of First Class at Kukatpally, Cyberabad.

(ii) On such release, the petitioner-accused shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) After release, the petitioner is directed not to contact the complainant or any other witnesses connected with the case or not to threaten any one of the witnesses. If there are any such threats from the petitioner, the complainant or Investigating Agency is at liberty to file an application for cancellation of the bail.

(iv) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS).

7. Accordingly, the Criminal petition is allowed.

Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date: 09.07.2026 YVL
