This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/Accused No.4 seeking to enlarge him on bail in connection with Crime No.52 of 2026 of Panjagutta Police Station, Panjagutta, Hyderabad. The offence alleged against the petitioner is punishable under Section 8 (c) read with 20 (b)(ii)(A), 22 (C), 27 (A), 27
(b) , 29 of the NDPS Act.
2. The case of the prosecution is that on 24.01.2026 at about 20:15 hours, the Sub-Inspector of
SKS,J crlp_10051_2026
Police, Panjagutta received a complaint that some drug peddlers who are involved in drug peddling are gathered at cellar of the Hamstech College, Nagarjuna Hills, Panjagutta Hyderabad, to supply MDMA and Narcotic Substances to their sub peddlers and customers. Then he obtained the permissions from his superior officers, registered a case and remanded the accused persons along with petitioner to judicial custody.
3. Heard Sri Umesh Singh, learned counsel for the petitioner/Accused No.4 and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent- State.
4. The contention of learned counsel for the petitioner is that the petitioner innocent of the offence alleged against him and he has nothing to do with the said offence and he did not commit any offence and falsely implicated by the investigating agency in the present case; that without making any preliminary enquiry, the petitioner was remanded to judicial custody; that material witnesses have already been examined and only filing of the charge sheet remains. Therefore, there is no possibility of the petitioner tampering with the prosecution evidence

or influencing the witnesses and hence, he prays this Court to grant regular bail to the petitioner.
5. On the other hand, learned Additional Public Prosecutor opposed the same and submits that the petitioner involved in a serious offence under the provisions of NDPS Act and he is alleged to be the sub- peddler; that the offence alleged against the petitioner is grave in nature and attract the rigors of the NDPS Act; that investigation is not yet completed and hence, he prays to dismiss the petition.
6. Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 25.01.2026. As seen from the record, L.Ws.1 to 16 were examined. Considering the period of incarceration, nature of allegation and progress in investigation, this Court is inclined to grant bail to the petitioner-accused No.4 subject to the following conditions:
(i) The petitioner-accused No.4 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned XIV Additional Chief Judicial Magistrate, Hyderabad.
