______ SKS, J I.A.No.3 of 2026
This Interlocutory Application is filed with a prayer to enlarge the petitioner-appellant-accused No.3 on bail by suspending the sentence imposed vide judgment dated 30.10.2025 in S.C.No.67 of 2022 passed by the learned Special Sessions Judge for Trial of Cases of Atrocities against Women-cum- IV Additional District and Sessions Judge, Nizamabad, wherein the petitioner was convicted for the offence punishable under Section 304-II of IPC and was sentenced to undergo rigorous imprisonment for a period of ten years and to pay fine of Rs.10,000/- and in default of payment of fine to undergo simple imprisonment for a period of six months for aforesaid offence.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor.
Learned counsel for the petitioner submitted that though there is no evidence on record to prove the guilt of the petitioner and the evidence of the prosecution witnesses suffers from material contradictions, the trial Court erroneously convicted the petitioner while acquitting accused Nos.1 and 2. He further submitted that the extra- judicial confessions allegedly made before PWs.4 and 5 do not support the prosecution case and that the petitioner has good grounds to succeed in the appeal. Therefore, he prayed the Court to allow the petition.
On the other hand, learned Additional Public Prosecutor opposed the bail petition, contending that there is no illegality in the judgment of the trial Court and the trial Court rightly sentenced the petitioner and that there are no merits in the petition and prayed the Court to dismiss the petition.
Perused the contents of the affidavit filed in support of the petition.
Having regard to the submissions made by the learned counsel for the petitioner, it is considered fit to suspend the sentence of imprisonment alone imposed against the petitioners till the disposal of the Appeal.
Accordingly, the sentence of imprisonment alone is suspended till the disposal of the appeal, and the petitioner is directed to be released on bail upon executing a personal bond of Rs.15,000/- (Rupees Fifteen Thousand Only) with two sureties of the like sum each, to the satisfaction of the learned Special Judge for Trial of Cases of Atrocities against Women-cum-IV Additional District and Sessions Judge, Nizamabad. During the period of bail, the petitioners shall not indulge in any criminal acts, failing which the respondent – State shall be at liberty to file a petition for cancellation of bail.
