ORDER
This Writ petition has been filed seeking to declare the action of the respondents, more particularly Respondent Nos.2 to 7, in not executing the permanent repair and restoration works of Thettekunta Tank situated at Nagaram Village, Husnabad Mandal, Siddipet District, pursuant to the contract agreement entered into with the private party vide proceedings dated 02.08.2025 and 08.08.2025 and Agreement No.2 of 2025-26, dated 08.08.2025, as illegal and arbitrary.
2. Heard Mr. Vadlakonda Ravi Kumar Reddy, learned counsel appearing for the petitioner, and Mr. Laxmalla Sandeep, learned "_"-
Assistant Government Pleader for Irrigation and r:AD appearing for respondent Nos.1 to 5.
3. When the matter is taken up for hearing, learned Assistant Government Pleader placed on record a copy ol' the letter dated 30.05.2026 issued by respondent No.4, as well as another letter dated 16.06.2026 issued by respondent No.3. The contents of the letter dated 30.05.2026 are as follows: "Hence, the Tahsildar Husnabad Mandal is reqLtested to Depute Revenue Inspector and Surveyor for the Demarcation of Bund and conducting panchana.na to take up the work immediately before the rainy season."
4. But, as per the letter dated 16.06.2026 containing the relevant instructions, the learned Assistant Govr:rnment pleader submits that the lands are patta lands. Thereforer, the Tahsildar, Husnabad, has been directed to demarcate the boundaries of the bund, conduct a panchanama, and determine whether the lands are patta lands or Government lands.
5. In view of the above, after issuing notice to both parties, the respondent authorities are directed to concluct a survey, If, upon such survey, the lands are found to belong to the Government, they shall complete all the necessary repairs within a period of three (3) weeks from the date of receipt of a copy of this order.
