2. The instant writ petition has been filed by the petitioner underArticle 226 of the Constitution of India seeking the following reliefls, viz.,
".........1o issue Writ or Order more particularly one in the nature of Writ of Mandamus declaring the action of the 2"d Respondent not releasing Medical Reimbursement Bill forwarded by the 3d Respondenu Joint Registrar-pum- Drawing Officer vide R.O.C. No. 112612025-Esll.4 dated 25.03.2025 for Rs.6,23,816/- as illegal, arbitrary and violation of principles of Natural Justice guaranteed under Articles 14, 21 and 309 of Constitution of lndia and observations covered in writ orders in W.P. 3. The petitioner herein is a retired employee of this High Court. Due to a medical emergency, he was admitted in the Yashoda Hospitals, Somajiguda, Hyderabad, and after undergoing the treatment, he was discharged on 06.11.2024 upon payment of the full medical bill of Rs.6,98,816/-. Subsequently, the petitioner forwarded the relevant documents to the High Court and from the High Court, the same were forwarded to the Director of Medical Education on 25.03.2025. However, since then, the Director of Medical Education did not initiate any action on the same. This has led to the filing of the present writ petition.
4. Recently, there was another identical matter which came up for hearing before this High Court in W.p.No.46677 of 2022, which was decided on 04.01 .2023. The Division Bench of this High Court while allowing the said writ petition made the following observations, viz., "3. The issue raised in this writ petition is no more res integra. Similar issue arose for consideration before this Court in W.P.No.26210 of 1995. ln the said writ petition also petitioner was an employee of High Court and when he submitted medical bills for reimbursement, small amount of reimbursement was granted from out of the total expenditure incurred by him for treatment. The respondents have taken a stand that even the employee of High Court was not entitled to full reimbursement of the expenditure incurred by him. Overruling the said objection, the Division Bench held as under: "ln view of the above, it has to be declared that the restrictions as in G.O.Ms.No.184 or any other order of the Government upon the reimbursement of the medical expenses to the Government employees are not applicable to the employees of the High Court unless they are made applicable by the Chief Justice of the Court. The impugned Government Order rejecting the claim of the petitioner in the aforementioned letter of the second respondent herein thus is wholly without jurisdiction; the same is accordingly quashed. Respondents are directed to consider the claim of the petitioner in the light of the rules uneffected by the Government Orders imposing restrictions upon the reimbursement of the medical attendance/treatment costs by various government Orders, strictly in accordance with the Andhra Pradesh lntegrated Medical Attendance Rules, 1972 as modified from time to time in consultation with the Chief Justice of the High Court. ln view of the directions aforementioned, no further discussion of the issues raised by the petitioner herein is required."
4. Similar issue was raised in W.P.Nos.19613 of 2005 and 22645 of 202Q. Following the decision in W.P.No.26210 of 1995 W.P.Nos.19613 of 2005 and 22645 of 2O2O are allowed.
5. According to the 3rd respondent, no Rules are formulated by the Hon'ble Chief Justice of the High Court and no restriction is imposed on the employees working in the High t
Court. Therefore, the principle laid down by the Division Bench of this court in w.P.No.2621O of 1995 holds field and in terms thereof, petitioner is also entitled to fult reimbursement of medical expenditure incurred by him for his treatment.
6. Following the said decision, this Writ Petition is also allowed and the respondents 1 and 2 are directed to reimburse the balance amount after deducting Rs.1,00,000/- already paid to the petitioner within a period of three months from the date of receipt of copy of this order".
5. Upon plain reading of the order of the Division Bench referred to above, we find that the present matter also being of identical nature can be disposed of in similar terms-
6. Accordingly, the present writ petition also stands allowed. The respondents are directed to scrutinize the bills raised by the petitioner for reimbursement and whatever is the admissible amount, the same shall be released forthwith without any further delay. There shall be no order as to costs.
7. As a sequel, miscellaneous petitions pending if any, shall stand closed. //TRUE COPY// / ! ,. l SD'. T.SREENIVASA REDDY ASSISTANT REGISTRAR G ,/ To, SECTION OFFICER
