3.1. The case of the petitioners is that petitioner No.1-college is a non-profit organization founded in the year 2000 and petitioner No.2-college was established in the year 2008 and was granted approval by AICTE and requisite affiliation by Jawaharlal Nehru Technological University. Respondent No.2 was constituted pursuant to the decision of the Hon'ble Supreme Court and was granted statutory recognition in the State by virtue of G.O.Ms.No.6, Higher Education (EC-2) Department, dated 08.01.2007, namely, the A.P. Admission and Fee Regulatory Committee (for Professional Courses offered in Private Un-aided Professional lnstitutions) Rules, 2006. After the bifurcation of the State, the said G.O.Ms.No.6 was lus',ce luvvad' 5r dev wp 11912 ZA26 adopted by the State of Telangana through G,O.Ms.No.26, dated 22.07 .2015, and the Committee was constituted 3.2 lt is stated that the Rules framed under Act 5 of 19g3 prescribe the procedure for fixation of fee and Rule 4 provides that the Fee Regulatory Committee shall call for the proposed fee structure from each institution and consider the same on the basis of various relevant factors in accordance with law, and the fee so notified shall remain valid for a period of three years. 3 3 lt is further stated that the petitioner-institutron stricily complied with the fee fixed by respondent No.2 for the block period 2022-2023 lo 2024-2025 While so, respondent No.2 issued a notification dated 1507.2024 calling upon instituilons to submit proposals for review and determination of fee structure for various courses is falling withrn its jurisdiction for the block period 202S_ 2026 lo 2027 -2028 Pursuant thereto, the petitioner_institution submitted its proposal seeking revision of tuition fee to Rs.1 ,45,000/_ for the said block period and furnished all relevant documents before respondent No.2 on 09.12.2024 3.4 lt is stated that respondent No 2, upon receipt of the relevant documents, schedured a personar hearing and heard the petitioner on 04.03 2025 regarding the proposed increase in fee. Durrng the - lustr.e luwad Sndevi wo t1912 7076 said hearing, respondent No 2 allegedly informed the petitioner that a tuition fee of Rs.1,35,000/- would be just and appropriate for the block period 2025-2026 to 2027-2028. Upon further discussion and deliberation, the petitioner accepted the said fee and respondent No.2 notified and recorded the same in its register. lt is stated that the petitioner signed the register maintained by respondent No.2 in the presence of all the Committee members accepting Rs.1,35,000/- as the fee to be levied for the aforesaid block period.

3.5. According to the petitioners, without notifying the fee as accepted and recorded In the register, respondent No.1 issued G.O.Ms.No.26 dated 30.06.2025 unilaterally fixing and notifying the fee determined for the previous block period 2022-2023 to 2024- 2025 lo continue for the academic year 2025-2026 in respect of the B.Tech course offered by the petitioner-institution. 3.6 lt is further stated that two similarly situated institutions filed W.P. No. 19571 of 2025, wherein this Hon'ble Court, by order dated 09.07.2025, permitted the petitioner institutions therein to collect the fee recorded in the register, while all other institutions were compelled to collect the tuition fee applicable to the previous block period for the academic year 2025-2026..

3.7. The petitioners further state that the institution was again called for a personal hearing on 01.09.2025. During the said hearing. the petitioner was allegedly coerced into signing the register in which the proposed fee column was left blank, on the assurance that the fee earlier agreed upon on 04.03.2025, namely Rs.1,35,000/-. would subsequently be inserted in the blank space.

3.8. lt is stated that, contrary to such assurance, respondent No.1 issued the impugned G.o t\Is.No.6 ot 2026 dated 04.03 2026 unilaterally fixing the tuition fee at Rs 1 ,02,9001-, thereby reducing the fee payable to the petitioner-institution to an amount lesser than what was agreed upon during the earlier hearing, without assigning any justification or reasons, and in a manner contrary to law 3 9 The petitio n ers-in stitutio n state that thereafter an application under the Right to lnformation Act was submitted seeking information regarding the basis on which the tuition fee for the B.Tech course was fixed for the block period 2025-2028 in the impugned Government Order. Respondent No.2 furnished a reply on 31.03 2026. Upon receipt of the said information, the petitioner claims to have noticed certarn errors in the calculations adopted by the respondents for fixation of fee
