ORDER:

This writ petition is filed seeking the following relief ". . . to /ssue writ, order or direction more padtcularly one in lhe nature of writ of mandamus. declaring the action of the respondents n not considering lhe representation, dated 01.06.2026 made by the petitioner school and issuing impugned notice dated 02.06.2026 being arbitrary, illegal, without jurisdiction or power and violation of principles of natural Juslrce besdes violating Petitioner rights granled under Aftrcles 14 and 21 of constitution of lndia and consequently direct the respondenls to grant one academic year of time to shift to alternate premises..."

2. Heard Mr. M.Phanindra Bhargav, learned counsel for the petitioner, Mrs. A.Santhosh Kumari, learned Assistant Government Pleader for School Education. Perused the record -

Brief facts of the case are that the petitioner-society is running an educational institution under the name and style of Sri Vanr High School since the year 2021 in the existing premises lnitially the institution was granted recognitron for classes Pre-Primary to Vll class (English lVediurn) which was subsequenily extended up to Class X, with recognition being valid up to the academic year 2032-2033. certain persons craiming to be members of a student organrzation by name Bahujan Student Federation (BSF) had been demanding money from the management for runntng the school without any disturbance. Upon the petitioner refusing to accede to such demands, a complaint was lodged by them before the respondent-authorities aileging that the schoor was being run without valid permission pursuant thereto, without affording any reasonable opportunity of hearing to the petitioner- society and without considering that admissions for the academic year 2026-2027 were arready compreted, the respondent-authorities have rssued impugned notice, dated 02 06.2026 to the petitioner,s school directing to rerocate the petitioner's instrtution to a safer location on or before 1206.2026, on the ground that the school premises abut Natronal Highway. The petitioner submitted a representation requestrng the respondenlauthorities to grant a reasonable period of one academic year i.e., 2026_2027 to facilitate compliance with the said direction. The said representation was not considered till date. Hence, the present writ petition.

When the matter is taken up, learned counsel for the petitioner submits that the petitioner has already submitted its explanation in response to the impugned notice, dated 02.06.2026. He further submits that the petitioner is willing to shift the school premises upon identifying a suitable and convenient location for running the institution and requested this Court to grant reasonable time for such relocation, as the academic year 2026'2027 has already commenced.

On the other hand, learned Assistant Government Pleader for School Education submits that the impugned notice was issued only with a view to afford sufficient opportunity to the petitioner to shift the school premises before any further action is contemplated. The notice is merely a preliminary measure intended to safeguard the safety and welfare of the students studying in the institution, having regard to the location of the school adjacent to the National Highway. Learned Assistant Government Pleader further submits that no final decision has been taken against the said institution. Therefore, the writ petition, having been filed at a premature stage, is liable to be dismissed.

- ln view of the undertaking given by the learned counsel for the petitioner that the rnstrtutron \/ourd be shifted to a suitabre rocation upon identifying appropriate premises, this Court rs of the opinion that some reasonable time deserves to be granted to the petitioner. Considerrng the fact that the academic year 2026-27 has already commenced and that an immediate relocation may adversely affect the interest of the students this court deems it appropriate to direct the petitioner to take earnest steps to identify a suitable and well equipped arternative premises and shift the rnstitution before the commencement of the next academic year i.e., 2027 _28.

Accordrngly, the Writ petition is disposed of. There shall be no order as to costs Pending miscellaneous applications, if anV, shall stand closed Sd/-L.VIJAYA LAXMI ISTANT REGISTRAR //TRUE COPY// SECTION OFFICER
