ORDER:
This Revier,r, i.A.No.3 of 2024 is f,rled. seeking to revlew the order dated lg.Og.2024 passed by this Court in W.P.No.25689 of 2024
2. This Court disposed of W.p.No.256g9 of 2024 on 19 .O9 .2024 u,ith liberty to the review petitioner to avail the statutory remcdies available under the Competition Act, 2002.
3. h is thc case of the review petitioner that as per the statute. there is no remedy of appeal provided against the impr-rgned order and the said fact *,as not brought to the notice of this Court at the time of disposal of the writ petition. 4 . It is stated by Mr. Avinash Desai, learned Senior Coun sel for r l-re review petitioner that questioning the order dated 19.09.2024 passed in w.p.No.25689 of 2024, thereview petitioner has filed ar-r appeal on the file of this Court namely W.A.No.55 of 2O2S and uide order dated 21.01.2025 in CVBR, J Reuiew I.A.N2.3 of 2024 in W.P.No.25689 oJ 2O24 W.A.No.55 of 2025, the Division Bench of this Court has kept the writ appeal pending and permitted the review petitioner to press'the review I.A.No.3 of 2024 in W.P.No'25689 of 2024 before this Court.
5. It is further stated by learned Senior Counsel for the review petitioner that this Court has referred to a decision reported in Cyrus Investments Prrt. Ltd' v' Tata Sons Ltd't and dismissed the writ petition. In fact, such case is not applicable to the facts and circumstances of the case'
6. In view of the above said reasons, the Review I.A.No.3 of 2024 is allowed and the order dated l9'O9'2O24 passed by this Court in W'P.No.25689 of 2024 is recalied and the writ petition is restored to its file.
