ORDER:
This Criminal Petition is filed seeking grant of bail to the petitioner, who is arrayed as an accused No.3 in Crime No.662 of 2025 on the f,rle of the RpS-Secunderabad police Station, GRP-Secunderabad, registered for offences punishabie under Sections 8c r/w 2o(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "NDPS Act").
2. Heard learned counsel for the petitioner as well as learned Additonal Public Prosecutor for respondent-State.
3. The brief facts of the case are that on 17.12.2025, while conducting a general check at the Railway Station, the police noticed two (02) persons, namely Mintu (A-2) and Nure Alam (A-3) under suspicious circumstances carrying two trolley suitcases and bags. Upon inspection, the police allegedly recovered 22 packets containing ganja weighing about 44.854 kgs, which the accused stated had been procured from one Rehman (A- 1) at Ytzianagaram and transported by train for further delivery to Delhi. The contraband was seized in the presence of mediators, samples were drawn, and other articles including mobile phones and train tickets were also seized. Based on the said seizure, the present crime is registered against the accused for the above offences.
4. Learned counsel for the petitioner/accused No.3 submits that the petitioner is innocent and has been falsely implicated in the present case, and that no specific overt acts are attributed to him. It is contended that the petitioner is a private employee working as a scrap collector and is the sole breadwinner for his family, having several dependents' It is further submitted that the petitioner was arrested on 17.12.2025 and has been languishing in judicial custody since then.
5. Learned counsel for the petitioner further submits that an earlier bail application filed by the petitioner 1n Crl.P.No .6802 of 2026 was dismissed by this Court on 05.05.2026 and due to changed circumstances, the present application has been filed
6. A perusal of the record reveals that this court, while dismissing the earlier bail application, specifically held that the twin conditions prescribed under section 3T ol the NDpS Act were not satisfied and there were no reasonable grounds to believe that the petitioner was not guilty of the alleged offence and that he was unlikely to commit any offence while on bail. This court further noted that the quantity of contraband allegedly seized constituted a commercial quantity and that serious allegations had been levelled against the petitioner. Accordingly, the earrier bail application was dismissed.
7. In the present petition, except reiterating the grounds urged earlier, no fresh or substantial circumstances have been brought to the notice of this court warranting reconsideration of the matter. The petitioner has failed to 'i
I
establish the twin conditions mandated under Section 37 of the NDPS Act for grant of bail. Moreover, the earlier bail application was dismissed by this Court only on 05.05.2026.
8. In view of the above facts and circumstances, and having regard to the serious allegations levelled against the petitionerfAccused No.3, this Court is not inclined to grant bail 9, Accordingiy, the Criminal Petition is dismissed.
