ORDER:
The petitioner is arra.ved as accttsed No.2 in Crirne No.829/2025 on the file of Nagole Police Station with the alleged offence under Sections 316(21, 318(4) of the BNS, 2023, and Sections 3 and 5 of the Telangana State Protection of Depositors of Financial Establishments Act, 1999.
2. Heard Sri M. Prudhvi Raju, learned counsel for the petitioner/accused No.2 as vvell as learned Additional Public Prosecutor appearing for the respondent-State.
3. The brief facts of the case are that the petitioner/accused No.2 along with other accused, induced the victim to invest - SCR, J Crlp_8 167 _2026 money in the narne of vR Trading services by promising returns from 10 percent to 16 percent per month. After collecting deposit, the accused initially paid returns to some victims. However, they subsequentry railed to repay the amounts.
4. Learned counsel for the petitioner wourd contend that the petitioner/accused No.2 has no connection with vR Trading Services and has no connivance in the commission of the said crime. He has been falsely impricated in connection with the said case. Learned counsel submits that the petitioner shall abide by any conditions ., th$ may be imposed if the petitioner/accused No.2 is enlarged on bail.
5. Per contra, learned Additional public prosecutor would contend that there has been a serious misappropriation of funds to €rn extent of Rs.3o crores by the petitioner/accused No.2 along with other accused and many of the accused who have connivance with each other are still absconding and are not available for investigation and it is a multi leveled marketing cheating in the n€une of deposit/investigation. 6' It is further contended that the investigation is still at the preliminary stage and the victims statements, has to be :, SCR, J Crlp_8167 2026 recorded. If the petitioner is enlarged on bail, it would be detrimental to the investigation
7. Evidently, the remand report of the accused would show that there are number of victims where the accused along with other accused under the multi level marketing scam cheated several victims and the financial implications in the said fraud is more than Rs.30 crores. Further investigation is required by arresting all other accused, who in connivance with each other, committed fraudulent activities
8. In that view of the matter, enlarging the petitioner/accused is detrimental to the investigation. Therefore, the criminal petition filed by the petitioner/accused No.2 is devoid of merit and is liable to be dismissed.
9. Accordingly, the Criminal Petition is dismissed. However, petitioner/accused No.2 is at liberty to move appropriate application to the jail authorities so as to show that she is handicapped. On such application being moved, if the circumstances stated by the petitioner/accused No.2 are correct, the respondent jail authorities shall provide such facilities as -r- SCR, J Crlp_8167 -2026 required to the petitioner/accused No.2, being a women and handicapped As a sequel, miscellaneous petitions pending, if any, shall stand closed.
