3. The brief facts of the case are that on the complaint made by the de facto complainant, on 2g.03.2026, at about 11.30 hrs, the petitioner/accused No.10 was arrested by the special police team at Y-Junction, Kukatpally, wherein the petitioner/accused No.10, on the instructions of accused No.1-Mr.Md. omer Sharecf, proceeded to Kukatpally on his Passion plus motor and followed the movements of the targeted victims i.e., two persons proceeding in Burgman vehicle with the pillion rider carrying a packed cardboard box behind and at about 2l:4o hours, when the victims reached near Pillar No. 836 at Kukatpally Junction, the petitioner/accused No.10 and the other accused allegedly executed the plan by throwing chilli powder on the victims, causing them to fall from the motorcycle. Taking advantage of the situation, accused No.1 allegedly snatched the cash box from the pillion rider. During the course of the incident, one of the accused, namely saddam, fell from his Honda Activa motorcycle bearing No. TG-09-c sga7 , which was left at the spot, and all fled from spot.
4. Thereafter, all the accused assembled near westin Hotel, Madhapur, where accused No.1 has given an amount of Rs.3 lakhs to the petitioner/accused No. 10. Subsequently, the petitioner switched off his mobile phone and travelled to various places iike Bangalore, Karnataka and Andhra Pradesh. Alter exhausting the said amount, he returned back to Hyderabad, where he was apprehended by the Police and brought to the Police Station.
5. Learned Public Prosecutor contends that the investigation is still in progress and that some of the accused persons are yet to be apprehended. It is further contended that il the petitioncr/accused No.10 is enlarged on bail, there is likelihood of the similar offences.
6. A perusal of the remand report reveals that it is a planned case of theft targeting innocent victims and siphoning huge funds and serious allegations are levelled against the petitioner/accused No.l O.
7. Having considered the nature and gravity of the allegations, the material available on record, and the fact that the investigation is still in progress, this Court is of the view that the petitioner/Accused No.1O is not entitled to be enlarged on bail at this stage and the same is liable to be dismissed.
7. Accordingly, the Criminal petition stands dismissed. Miscellaneous applications, if any pending, shall stand closed. SD/- P.C.SULEKHA DEVI ASSISTANT REGISTRAR //TRUE COPY// CTION OFFICER
