ORDER

These Criminal Petitions are filed under Section 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') seeking grant of bail to the petitioners, who are alrayed as accused Nos.l and 2 resepectivey in Cr.No.F.No.DRI/FZUI48E/ENQ- 1 0(INT-10)12026 on the file of the iearned XXV Additional Judicial Magistrate, at Rajender nagar, Cyberabad, R.R. District, registered for the offences punishable under Sections 20,23,28 and 29 of the NDPS Act, 1985

2. The brief ibcts of the case are that, based on the specific and credible intelligence developed, officers of the Directorate of Revenue Intelligence (DRI), Hyderabad Zonal Unit, had reasons to believe that two passengers namely Mr. Pilassery Meethal Thajul Diyoof (holding Passport No V5206949) and lr'{s. Valappil Safa Abdulla (holding Passport No. V2217244) travelling from Bangkok (BKK), Thailand to Hyderabad by Ind. Flight No.6E-1058 arriving in the aftemoon of 19.05.2026, bearing PNR No. P982X1M were lilicitly carrying narcotic drugs in contravention of the provisions of the Narcotic Drugs and Psychotropic Substances Act, 1985. Accordingly. at abcut 14:40 FIrs (02:40 PM) on 19.05.2026, the officers of DRI, Hyderabacl have intercepted the said passengers namely Mr. Pilassery Meethal Thajul Di-voof and Ms. Valappil Safa Abdulla, at the green channel ry area of the Customs International Arrival Hall, Rajiv Gandhi International Airport, Shamshabad, Hyderabad, in the presence of two independent panch witnesses and introduced themselves as officers of DR[, tlZU by showing their Identity Cards and the respondent authorities have seized the contraband of 8.705 kgs of Ganja/I\4arijuana from the possession of petitioners/accused Nos.l and2. Hence, the Complaint.

3. Heard IVIr. Mohammed Ghouse Pasha, learned counsel for the petitioners and Mr. Dominic Fernandes, learned Senior Standing Counsel For CBIC appearing for the respondent.

4. Leamed counsel for the petitioners submitted that the petitioners are innocent of the allegations levelled against them and have been falsely implicated in the present case. It is submitted that the petitioners, who are arrayed as Accused Nos.l and 2, have been in judicial custody slnce 20.05.2026. Learned counsel further submitted that the contraband allegedly seized suspected to be GanjalMarijuana from the possession of the petitioners is 8.705 kilograms, which falls within the category of intermediate quantity. It is further contended that there is no statutory bar preventing the petitioners from approaching this Court directly for grant of bail and on the aforesaid grounds, learned counsel prayed that this Court may be pleased to enlarge the petitioners on bail by allowing the present

Criminal Petitions. However, learned counsel fairly submitted that, for proper appreciation of the facts and circumstances of the case, it may be desirable for the petitioners to approach the jurisdictional Court having jurisdiction to consider an application for bail under the relevant provisions of law.

5. On the other hand, the learned Senior Standing Counsel vehemently opposed the subrnissions made by the learned counsel for the petitioners and opposeci the gran! of bail. It is submitted that the petitioners have an efficacious alter-native remedy of approaching the learned trial Court having competent jurisdiction for seeking bail. Therefore, it is prayed that the present Crirninal Petitions be dismissed.

6. In the light of the submissions made by both sides and upon perusal of the material available on record, it is evident that the petitioners have been in judicial custody since 20.05.2026. The contraband allegedly seized from their possession is 8.705 kilograms of substance suspected to be Ganja/Marijuana, which falls withir,r the category of intermediate quantity.

7. Having regard to the facts and circumstances of the case, and consideringthat the petitioners have not approached the jurisdiction Court seeking baii in the first instance, this Couut is of the considered opinion that the present Criminal Petitions are not liable to be entertained at this stage.

8. Accordingly, the Criminal Petitions are dismissed. However, the petitioners are at liberty to renew the application after a while. Miscellaneous applications, if any pending, shall also stand closed ! J //TRUE COPY/ SD/. C.DEEPIKA ASSISTANT REGISTRAR nal Judicial Magistrate of (' }'/ ECTION OFFICER to' {;* 1.
