ORDER:

1. The petitioner is arrayed as sole accused in Crime No.7ll2026 on the file of Mallapur Police Station, Jagitial District, for the alleged offence under Section 103(1) of the BNS, 2023.

2. Heard Sri Madas Bharath Chandra, learned counsel for the petitioner/accused as well as learned Additional Public Prosecutor appearing for the respondent - State.

SCR, J Crlp_8163_2026

3. The brief facts of the case are that on 11.04.2026 the defacto-complainant lodged a complaint with the porice stating that the petitioner/accused indiscriminately beat his mother on her face and forehead with his hands and pushed her down with an intention to kill her, due to which her mother sustained bleeding injuries and succumbed to the said injuries. Thus, requested to take necessary action.

4. Learned counsel for the petitioner would contend that the entire investigation has been completed and a false case was filed against the petitioner/accused and the witnesses have already been examined and that the petitioner was arrested and remanded to judicial custody on 12.04.2026, and has been languishing in the judicial custody since then.

5. Per contra, learned Additional public prosecutor would contend that serious allegations are made out against the petitioner/accused, that he has caused the death of his own mother by indiscriminately beating her on her nose and forehead, so as to kill her. 6 Evidently, the said contentions of the learned Additional Public Prosecutor are supported by the remand report along '-7 SCR. J Crlp_8163_2026 with the investigation, which prima facie, reveal that grave allegations are leveled against the petitioner. At this stage, since the investigation is still in progress, the criminal petition filed by the petitioner/accused is not fit for consideration and lacks merit, and accordingly liable to be dismissed.

7. In the facts and circumstances above stated, the criminal petition stands dismissed. As a sequel, miscellaneous petitions pending, if any, shail stand closed. SDr- MOHD.ISMAIL DEPUTY REGISTRAR // ,ITRUE COPY/' A SECTION OFFICER To Pr/KA
