02. Heard Sri Emmadi Upender, learned counsel for the petitioner, Mr. K.Shgrath, learned Assistant Government Pleader for Higher Education appearing for respondent No.1
and Sri M.Mehboob Ali, learned Standing Counsel for AICTE appearing for respondent No.2 and Sri prabhakar peri, learned Standing Counsel for JNTUH Even after service of notice, none appeared on beharf of the respondent.No.4. perused the record. 03 Case of the petitioner is that the petitioner was admitted to the respondent No.4_college for B.pharmacy course. all her original certificates, including SSC Memo, lntermediate Marks Memo, Transfer Certificate & Bonafide certificate, were retained by the Management of respondent No 4-college She attended classes for about two months. Thereafter, she discontinued the studies lt is the further case of the petitioner that even after requesting the respondent No 4-college, they declined to return the above original certificates Hence, the writ petition is filed. 04 Learned counsel for the petitioner submits that the petitioner requires her original certiflcates for joining higher studies. He further submits that the action of respondent No.4 in withholding the original certificates submitted by the .try petitioner at the time of admission is illegal and arbitrary Therefore, he seeks a direction to respondent No.4 to forthwith return the petitioner's original certificates
05. lt is not in dispute that the original certificates of the petitioner referred to above were submitted before the respondent No.4 at the time of admission and the petitioner had discontinued her studies from respondent No 4-college. The said certificates, being personal and academic credentials, are undoubtedly the property of the petitioner. ln such circumstances, respondent No.4-college has no authority whatsoever to retain the said certificates and the retention of the petitioner's original certificates by respondent No.4 is wholly unjustified and cannot be sustained. Even assuming that the college has any monetary claim against the petitioner, withholding her original certificates cannot be adopted as a mode of enforcing such claim, the proper remedy, if any available to the college is to proceed in accordance with law for recovery of its dues, but not retain the petitioner's original certificates t To, TJ
06. For the foregoing discussion, this Writ petition is allowed, directing respondent No.4_college to forthwith return the original certificates of the petitioner to her. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed Sd/.AHMED ABDULLA KHAN ASSISTANT REGISTRAR //TRUE COPY// SECTION OFFICER
