2. Fceling aggrieved and dissatisficd with the order dated 30.07.2025 t)assed bythe learned SingleJudge in W.P.No.l5l90 oi : !

2025, unsuccessful writ pctitioners preferred the present intra - court appeal under clause l5 of the Letters Patent.

3. Appettants joined in respondent No.8 - College in DM/MCh (Doctorate of Medicine, Master of Chirurgiae). At the time ol loining, respondent No.8 - College has obtained an undertaking to serve the Covemment of Telangana by working in Govemment Hospitals for a period of two (2) years after successful completion ol Super Specialty Course (if required), in case, if they fails to join as Senior Resident or in case of not completing two years of service within maximum period of 36 months, they undertook to pay a sum of Rs.50,00,000/- (Rupees fifiy lakhs only) to Govemment in tenns ol G.O.Ms.No.l65 of 2017, dated 06.09.2011 . While joining the said course, they have submitted the originals of the following certificates to respondent No.S College:

i) Permanent Medical Registration Cerlificate (MBBS & PG);

ii) Permanent MBBS Degree Certificate;

iii) Provisional PG Degree Certificate;

iv) Intemship Completion Certihcate;

v) Bonafide Certihcate (MBBS & PG);

vi) Conduct Certificate (MBBS & PC); I I I i I i Ij I i i I i i l vii) SSC/CBSE ( l0'r') Marks Mcmo;

viii) 12'r'Marks Memo;

ix) MRBS Marks Merno/Consolidatcd Memo;

xii) Migration Certifi cate. They have successfully completed the said course during the acaclenric year 2024-2025. E,ven then, respondent No.S - College has not returrred thc aforesaid original certif-rcatcs on the ground that appellants f ailed to rvork in Govemment Hospitals for a period of trvo years in terrns olthc undertaking given by the appellants.

4. lt is the specilic contention of the appellants herein in the said writ petition that respondent No.8 College has no power or authority to withhold the original certificates. In case of violation ol the aforesaid undertaking given by the appellants, at the most, respondent No.8 - College can file a suit seeking recovery of rnoney, but it can't withhold the certificates.

5. Learned counsel for the appellants has also placed reliance on thc principle laid down by this Court in Malraju Suhithu v. The State ol.,felungans, Rep. by its Principal Secretary, Higher

Vide the order dated 24.01 .2020 in W.P.No.2l137 of 2019, the Division Bench of this Court struck down paragraph No.7 (iii) ol G.O.Ms.No. ll4, dated 05.07.2017 i.e., original certificates submitted by the candidates shall not be returned to them, titl they complete their course ol study and appear for the university examination holding it as un-constitutional. A similar view was also taken by this Court in Mahatna Gandhi Law College, NTR Nagar, Hyderabad v. Sture of Telanganar and in Sai Lakshmi Saranya v, The State of Telanganaa.

7. Thus, respondent No.8 College has no lien over the original certificates of the candidates including the appellants herein. If appellants violates the aforesaid undertaking, respondent No.8 - College is entitled for an amount of Rs.50,00,000/- from the appellants on the ground ol the violation of the said undertaking, W.l'.No.27361 of 2025, decided on 12.09.2025 W.P.No.40218 of2025, decided on 09 01.2026 w.P.No-22417 of 20 t 8, decided on 09. 12,2022 w.P.No.25359 of 2014, decided on 29.10.2024
