Heard Mr.P.Raghavcndra ltao, learned couusel for the Applicants and Sri E.Ajay Reddy, learned Senior Counsel representing Ms. E.Anisha Reddy, appearing for respor-rdents.
2. The present Arbirrarion Apptication is filed under Section I I (4) and (6) of the Arbitration and Conciliation Act, 1996 (hereinafter .the Act, 1996') for appointment of Arbitrator to adjudicate the disputes between the panies. I

According to thc applicants' therc are disputes between the applicants and the resporrdcnts rvith rcgard to the development of property covered under thc said JDA - cum - GPA dated 03'04'2019' Therefore, the applicants have issued notice dated 23 '04 '2025 proposing Sri Justice C.V'Ramulu' l'ortrcr Judge of erstwhile High Court of Andhra Pradesh as their arbitrator and requested the respondents to jointly nominate/appoint their Arbitrator as per clause No'17'02 of the agreement dated 03'04'20t9 cnabling both the arbitrators to appoint a third arbitrator/presiding arbitrator to receiving and acknowledging the notice resolve the disPutes' DesPite , respondents did not resPond' Therefore, the applicants filed thc present application' I \ r$&t.,: i l

It is apt to,otc that as per the aforcsaid crause No.17, both the parties have agreed lbr aplointtnent of a pancl of thr.ec arbitrators, one each appointed by the part ies and the two ar.bitrators appointed by the parties shall appoint the third arbitraror, who shalr be the chairman of the arbitrar tribunal' Both the lcanred counscr ror the appricants and senior counsel appearing lor respondents agreed lor appointment of sole arbitrator. Thus, the aforesaid lacts would r.o,eal that there are disputes between the applicants and the rcspondents with regard to the development of the subfect properly covcred under the said JDA - cum _ GPA dated 03.04.2019..I-he sar.ne are arbitrablc in naturc. 7 rn the light of tl.re aroresaid discussion, the present Arbitration Application is allowcd.
