ORDER
Heard Mr. Bhasker poluri, leamed counsel for the applicant Notice sent to the respondent is returned unserved with an endorsement "Addressee left without instructions,,. Sending notice ro respondent to the address availabre is sufficienl sen'ice in terms of Section 27 0f the General Clauses Act, 1g97. None appears on behalfofthe respondent.
2. The present Arbitration Application is filed under Section l l (5) and (6) of the Arbitration and Conciliation Act, 1996(hereinafter .the .E:
Act, 1996') for appointment of Arbitrator to adjudicate the disputes between the parties 3' Both the appricant and the respondent have entered into a Franchise Agreement with Sustainkaft, dated o4.rr.2o2z. Thereafter, disputes arose between the applicant and the respondent with regard to the execution of the said agreement, dated 04.1 I .2022.
4. Clause No. l5 of the said agreement deals with arbitration and the same is extracted below:- l5.Arb rtration: Any dispute/s or differencc/s rvlratsoevcr arising under or in connection with this Agreement which couldn't be settled by the both parties through negotiations, shall be settled by arbitration irr accordance with the Arbitration and Conciliation Acr, 1996. All proceedings shall be conducted in English and the proceeding shall be conductcd by a solc arbilraror appointed mutually by both parties. Venue lor arbitration shall be in Hyderabad, tndia.
5. While so, the respondent unilateraily cancelled the tanchise agreement vide legal notice dated 01.06.2023. The Applicant issued reply dated 20.06.2023 requesting the respondent to come forward to resolve the disputes through Arbitrator and proposed Sri V.V.Raghavan, as an arbitrator. 6. The aforesaid facts would reveal that there are disputes between the applicant and the respondent with regard to the execution of the Franchise Agreement vvith Sutainkart' dated 04 'll '2022' The same are

In the light of the aforesaid discussion' the present Arbitration Application is allowed' Accordingly' Sri T'Raghuram' Retired District Judge, Flat No.402, 4tr'Floor' Kishan Residency' Shyamlal Buildings' Begumpet, Hyderabad, Mobilc No'9704377419' is appointed as sole Arbitrator to adjudicate the disputes between the parties' The parties are at liberty to take atl the available pleas and defences before the learned arbitrable in nature sole Arbitrator.
