2. Heard Mr. Y.V.S.S.Siva Sarma, learnecl counsel for the petitioners, Mr. K.Sharath, learneci Assistant Go,ernment pleader foi' Higher Education appearing for responderrt los.2 and 3 and Mr. Prabhakar Peri, learned Standing Counsel fc,r JNTU appearing for respondent No.4. There is no representati: r for respondent No.6.

Case of the petitioners is that they hare pursued their Engineering course in respondent No.6 cc,l ege and upon completion of their studies, they have approacherl lhe rnanagement for return of their original certificates by nraking several representations. However, respondent No.6 refur;, ,d to return their original certificates and insisted them to pay the.en re fe'e for the full four year course, relying upon the guidelines issu,: I by the Finance (SCSDF & STSDF) Department vide U.O.l',lc .27O0O86O1N97t SCSDF/202, dated 06.09.2024. Hence, the present writ petition.

4. Learned counsel for the petitioners submitr; that the AICTE, vlde Lr.No.1-1 01/PG/AICTE/Regulation/2019, datec 29.03.2019 and the Telangana State Council of Higher Education by LT.No.TSCHE/Fee ReimbursemenU2O24, dated 1t ; 02 2024, have directed the Directors/Principals and Registrars of ;r the universities

Iush.elLw.d' sldev' wP _?474_2026 not to withhold or retain the original certificates of students and not to insist upon payment of fees from students who are eligible for fee reimbursement.

5. Learned counsel for the petitioners submits that as a result of the action of respondent No.6 college in withholding the original certificates, the petitioners were irretrievably deprived of the opportunity to submit applications for further studies at their institution of choice for TS/TG PGSET 2026 lo 2028 Phase-ll. The petitioners are not in a financial position to pay the amount demanded by respondent No.6. He further submits that the action of respondent No.6 in withholding the original certificates of the petitioners is illegal and arbitrary. Therefore, he seeks a direction to respondent No.6 to forthwith return the petitioner's original certificates

6. Perused the record.

7. lt is not in dispute that the petitioners have completed their studies in respondent No.6 college and their original certificates are in the custody of the said college. A bare perusal of the Lr. No.TSCH E/Fee Reimbursement/2O24, dated 23.02.2024 issued by the Secretirfr fut"ng"na State Council of Higher Education, rl (

lustice luwad, Sdev *p 7474_2026 reveals that specific instructions were issued cli-r cting all affiliated Private Colleges not to insist upon payment of tuition fees from students who are eligible for the fee reimburser r nt from the State Government. Further, as per the guidelines of tJ lC, no college is entitled to withhold or refuse to return any do() tments, including degree or diploma cerlificates or any other awards deposited with it by students for the purpose of seeking admission

8. The certificates, being personal and acader.t c credentials, are undoubtedly the property of the petitioners. ln sr r h circumstances, respondent No.6-college has no authority whatso rver to retain the said certificates and the retention of the p,: itioner's original certificates by respondent No.6 is wholly unjustifie C and cannot be sustained. Even assuming that the college has arl monetary claim against the petitioners, withholding their original ::rtificates cannot be adopted as a mode of enforcing such claim. Tlr : proper remedy, if any available to the college is to proceed in ac; rrdance with taw for recovery of its dues and not by depriving the I ltitioners of their rightful original certificates.
