Petitioners herein have filed a suit in o.S.N o.42 of 2026 against the respondents herein seeking to grant decree of cancelling the revocation of settlement deed, dated 05.06.2024 as null and void, to declare plaintiff No.1 as absolute and larvful owner of the money available in the Bank Accounts o1'defendant No.l and also for permanent injunction.

4. Petitioners have filed the aforesaid three interlocutory applications with the following reliefs:

i) I.A.No.l66 of 2026 is filed seeking ad-interim iniunction restraining the respondents, their agents, henchmen, workmen and other representatives, whoever is claiming under them, from interfering with the management and affairs of plaintiff No.l and its Church over the schedulcs A, B, C and D properties;

ii) I.A.No.l76 of 2026 is filed seeking a direction to respondent No.l0 - Bank to freeze the account bearing No.34990163588 standing in the name of respondent No.1 to the extent ol'available balance amount till the disposal of the suit; and

iii) I.A.No.l65 of 2026 is filed seeking ad-inrerim injunction, restraining respondent Nos.l to 9, their agents, servants or any other persons claiming through or under the'm from alienating or creating any charge over the schedules A to D properties in favour of any third parties.

5. vide the impugned orders, learned trial court ordered urgent notice to the respondents and posted the matter on I 1.03 .2026. revived and that they owned the church property now, brandishing the revocation deed, dated 05.06.2024 (document executed on 07 .08.2024). Respondents/defendants aggressively asserting that petitioner No.l - Society is dissolved. It is their apprehension that respondents may interfere with the possession of the petitioners over the subject properties and also create ruckus, on Sunday during prayers.

In paragraph No.23 of the plaint, petitioners have not stated that respondents have created ruckus on 22.02.2025 (Sunday) during prayers, though they have filed the subject suit on 23.02.2026 so also with regard to Bank account.]'hey have not mentioned the urgency in the affidavits filed in support of the aforesaid interlocutory appl ications.

7. It is apt to note that for granting ex parte injunction, the petitioners have to satisfy the learned trial Court with regard to the following three aspects i.e., i) primafacie case, ii) balance of convenience and iii) irreparable loss. The said principle was also

) laid down b.y the Apex Court in catena ofjudgments. Therefore, it is for the: petitioners to satisfy the learned trial Court with regard to thr: aftrresaid three aspects to grant an ex parte order and it is for the learned trial Court to consider the same.

8. In present case, vide the impugned orders, dated 25.02.2026 and 26.02.2026, learned trial Court ordered urgent notice to the respondents; and posted the rnatter on I 1.03.2026.

9. Thus. petitioners failed to make out the aforesaid aspects to grant ex parte injunction. Therefore, learned trial Court ordered urgent notioe and posted the matter on I I .03.2026. If there is any urgency, it is for the petitioners to file an application seeking advanceme:nt of the aforesaid interlocutory applications to any other date and it is for the learned trial Court to consider and dispose of the same, in accordance with law

10. Thur;, petitioners herein failed to make out any case to I ali \ interfere vrith the impugned order.

[n the light of the aforesaid discussion, these civir Revision Petitions are disposed of granting liberty to the petitioners to file an application seeki.g advancement of hearin-e of the aforesaid interlocutory applications from 11.03.2026 to any date and it is for the learned trial court to consider the same and also aforesaid three interlocutory applications and decide the same, strictly in accordance rvith law. As a sequel thereto, misceilaneous petitions, if any, pending in the civil Revision petitions shall stand closed. There shall be no order as to costs. SD/.
