\ \ grantirg liberty to the petitioner therein to approach the civil court under section 34 of the Arbitration and conciliation Act, 1996. Therefore, the present writ petition is not maintainable in view of the alternative statutory remedy. 5' Having heard the learned counsel on both side-s and perused the material on record, this court finds that the acquisition in question was undertaken under the National l{ighways Act, 1956. Section 3G of the National Highways Act, 19s6, provides a specific statutory mechanism for determination and redetermination of comp*nsation. In case of dissatisfaction with the amount determined, the remedy available to the aggrieved person is to approach the Arbitrator under Section 3G(5) of the National Highways Act, 1956. Further, any chailenge to the award of the Arbitrator lies under section 34 of the Arbitration and conciliation Act, 1996. In w.p.No.254o6 of 2oo5, the t-{on'blc t{igh court of Andhra Pradestr, in similar circumstances, helcl Lhat ,*,hen the statute provides a specific remedy under Section 3G(s) of thc National l-Iighways Act, 1956, and a further remedy under section 34 of the Arbitration and conciliation Act, 1996, a writ petition under Article 226 of the constitution of India is not maintainable. This court is in respectful agreement with the. said view.
6. Accordingly, the writ petition is disposecl o{', granting liberty ro the petitioners to avail the appropriate rcmedy avaitable under law, if so advised. It- is made crear that this court has not exprcsscd any opinion on the merits of the case. No costs. \ \ tt i I
