3. When the matter is taken up for hearing, learned counsel appearing for the petitioner contends that the present writ petition has been filed to remove the illegally erected tin sheds by encroaching the Lateef Road and running the illegal beef and meat business in the portion of the said road, which is causing lot of nuisance to the public in general. Since the said running beef business is detriment to the public health at large, the petitioner submitted representation dated O5.08.2O16. Pursuant to the said representation, though the respondents have filed counter proposing to take appropriate action by admitting the said encroachments, they are not taking so.

6. Be that as it may, when it is up to Municipality to relocate the unoffrcial respondents to a proper place. The beef shops are being run on the road margins by encroaching Lateef Road which is detriment to the public health. As such, respondent No.2 also admitted that they would remove the said encroachment by following due procedure.

7. It is emphasized by the learned counsel for the petitioner that the counter was filed by the respondent No.2 in the year 2016 and even after lapse of eight years, the respondent has not contemplated any action. Ilr \
