2. Further, the Member (Finance) dissented from rhe opinion of the Member (Technical), wp 9953_2024 NBK, J and the Independent Member stated that he agrees with the view of the Hon'ble Members. It is therefore contended that the impugned order dated 22.01.2024 was not passed by a majority of the members of the quorum. Further, the Member (Technical), who is also functioning as Chairperson (FAC), exceeded her jurisdiction by passing the impugned order dated 22.01.2024 contrary to the provisions of the Elecficity Act, 2003, the GTCS, and the I'ariff Orders issued by the Telangana Electricity Regulatory Commission. 2.1 It is also contended that the 2nd respondent-Forum erred in not appreciating, the fact that the TSERC has the sole power to frame regulations under the Electricity Act, 2003, and that if a consumer is aggrieved by any clauses of the GTCS or the -l'arit-f Orders, the consumer must approach TSERC by rnaking a representation. Upon the orders passed on such representation, the aggrieved party has a statutory remedy of appeal before the Electricity Tribunal under Section lll of the Electricity Act, 2003.
