As discussed supra, in the present case, once therc is cancellation ol- agreenrent ot'sale, necessarily the plaintilt's have to seck only declaration and the1, cannot seck specific perfomrance o1'the agrcenlent of sale dated 08.10.2018. The said principle was also laid dori n by the Apex Court in the aforesaid judgments. There is no error in it. It is not an illusori'pleading and the plaint is not cleverly drafted plaint as alleged by the defendants.

37. It is also not in dispute that the vendee, the husband and t-ather ol the plaintil'ls, was tenant of the suit schedule propefty.

l1 l'herefore. the dcl-endants issued quit notice dated 24.0 1.2025 under Section 106 ol- the .[ P .\ct -l'here is no dispute with regard to legal position that posscssion of'the suit schcdulc- propefiv cannot extend limitation to tl lc- u sr.rit lirl sIccific perlbrurance of agrecment sale. 18.
