Despite the matter being listed under the caption 'for dismissal', even today, there is no representation on behalf of the appellants as well as respondent.

This appeal

IS hled against judgment and decree dated 09.02.2004 in O.S.No.3S of 2001 passed by the learned Judge, Family Court, Secunderabad. The iippellants herein filed the aforesaid suit claiming maintenance of Rs.15,000/- per month and also past maintenance of Rs.1,80,000/- and other reliefs from the respondent.

Vide impugned judgment and decree, leamt;r tnal Court retumed the plaint with a liberty to the appellants, [, present the same before the proper Court within one week from tI e date of the judgment.

vide order dated 31.03.2004 in c.M.p.No .7172 >f 2004,this Court discharged rhe l.tappellant as guardian of the 2,,, appellant.

In the light of the same, this appeal is dismilrl ed for non_

prosecution. Miscellaneous apptications pending, if an1 shall stand closed. There shall be no order as to costs.
