ORDER:

, This criminal revision case is filed seeking tc set aside the condition in order dated 19.12.2025 passed in Crl.l\ .p.No.1366 of 2025 on the file of the learned I Additional Distrrct and Sessions Judge, Sanga Reddy District, directing the petitione r accused No.2 to deposit surety of Rs.40,0001 towards interim cus ody of mobile phone or in the alternative, alter the said conditit r by directing release of the said mobire phone to the petitioner c r furnishing a personal bond and pass such other orders.

' ls, I Crl.R.C.No.1018 of 2025

3. Learned counsel for the petitioner submrts that the trial Court, while granting interim custody has imposed a harsh financial condition wrthout considering the petitioner's financial situation before imposing such a condition which is against the principles of equality and justice.

4. lt is further submitted that the petitioner has been cooperative throughout the investigation. The petitioner has already been granted bail by the Sessions Court, Sangareddy and has complied with all conditions thereof and any condition imposed by a judicial authority must be fair, reasonable and proportionate to the purpose it is meant to serve. ln the present case, the direction to furnish a surety more than the full market value of the mobile phone is clearly exOessive and unreasonable. Such a condition is unfair and causes unnecessary hardship to the petitioner. Hence, prays to set aside the condition in the order passed by the trial Court and allow the revtston.

5. Learned Additional Public Prosecutor opposed the same and prays to dismiss the revision

6. ln view of the above and in the facts and circumstances of the case, this Court is inclined to reduce the surety amount imposed by the trial Court from Rs.40,0001 to Rs.10,000/- i :f;i:'-{
