ORDER:
Heard Sri A. Chandra Shekhar, leamed c(,r nsel for the petitioner and Sri S.R. Sanjeev Kumar, Iearned counse rppearing for the respondent.
2. This revision is fited under Article _ 227 of tl< Constitution of India, to set aside the order dated 1g.09.2025 passed ir I.A.No.l9l0 of 2025 in I.A.No.l669 of 2025 in O.S.No.60g of t025 by the Principal Senior Civil Judge, Medchal Makajgiri District, Kushaiguda.
3. The petitioner/plaintiff filed the aforesaid su.t against the respondent/defendant seeking recovery of money for F1.19,00,600/_ (Rupees Nineteen Lakhs and Six Hundred only). Along vjth the said suit, the petitioner has filed I.A.No. 1669 of 2025 under (). Cer 3g Rule 5 of CPC seeking attachment before judgment. Vide rrder dated Between Goalla Rajitha /
25.0E.2025, leamed trial Court issued warrant of attachment before judgment. In the meanwhile, respondent/defendant filed I.A.No.19l0 of 2025 in I.A.No.1669 of 2025 in O.S.No.608 of 2025 to raise the said warrant dated 25.08.2025 issued in I.A.No.l669 of 2025. Vide order dated 18.09.2025,learned trial Court raised the said attachment.
4. During the course of hearing, it is brought to the notice of this Court that the pleadings in I.A.No.1669 of 2025 are complete and the order dated 25.08.2025 in I.A.No.1669 of 2025 is at ex parte order.
5. In the light of the same, this revision is disposed of setting aside the order dated 18.09.2025 passed in I.A.No.19l0 of 2025 in I.A.No.1669 of 2025 in O.S.No.608 of 2025 and accordingly, the said petition is dismissed. Learned Principal Senior Civil Judge, Medchal Makajgiri District, Kushaiguda, is directed to dispose of I.A.No.l669 of 2025 filed by the petitioner - plaintiff under Order 3E Rule 5 of CPC afresh, strictly in accordance with law as expeditiously as possible preferably within a period of one month from the date of receipt ofa copy ofthis order. Liberty is granted to both the parties to file additional affidavits, documents, if any, and it is for the trial Court to consider the same.
