:ORDER:

Challenging the order, dated 09.'1 0.2025 passed tn Crl.M.P.No.581 of 2024 in S.C.No.174 of 2024 bythe learned Senior Civil Judger-cum-Additional Chief Judicial Magistrate, Medchal- It/alkajgiri District at Kukatpally (for short 'trial Court'), this Criminal Revision Carse is filed. By the impugned order, the petition filed by the petitioner under Section 250 of BNSS (previously Section 227 of Cr.P.C.) seeking to discharge him was dismissed.

2. Heard Mr. S.Akhilesh Reddy, learned counsel for the petitioner and Mr. M.Ramachandra Reddy, learned Additional Public Prosecutor a,ppearing for respondent No.1-State. lnspite of service of notice, th,-.re is no representation for respondent No.2-de facto complainant. Perused the record.

a'

3. Basing on the complaint, dated 30.05.2021 lodged by the de facto complainant alleging the death of her sister, a case in crime No.42B of 2021 was registered under section 174 of cr.p.c. and investigation was taken up. During the course of investigation, it was revealed that the petitioner, who was the boyfriend of the deceased, had denied marrying her, leading her to commit suicide. consequently, a charge sheet was filed against the petitioner before the Magistrate court for the offences under sections 411, 420 and 306 of lPC. The same was taken cognizance of and nunlbered as P.R.c.No.3O of 2022, which was thereafter committed to the court of sessions and re-numbered as s.c.No.174 of 2024. pursuant thereto, summons were issued to the petitioner. Thereafter, the petitioner filed a discharge petition before the trial Court. Upon perusal of the material available on record, the learned Magistrate dismissed the said petition. Aggrieved by the said order, the petitioner has.filed the present Criminat Revision Case.

4. Learned counsel for the petitioner submits that the learned Magistrate failed to properly appreciate the material available on record and mechanically passed the impugned order disrnissing the discharge petition filed by the petitioner. Either in the complaint or in the FtR, the name of the petitioner did not find place. The entire case against the petitioner rests solely on the statements of &

nti n \ \ witnesses recorded under Section 161 of Cr.P.C. There is neither abetment nor instigation attributable to the petitioner in relation to the commir;sion of suicide by the deceased. However, the learned Magistrate overlooked these crucial aspects and dismissed the discharge petition filed by the petitioner without application of mind Hence, he prayed to set aside the impugned order.

5. On tle other hand, learned Additional Public Prosecutor submits that the petitioner had informed the mother of the deceased over phone that the deceased had consumed some unknown pills and was undergoing treatment in the hospital. The very fact that the petitioner was the first person to have knowledge of the incident clearly establishes his involvement in the alleged offences. He further submits that the learned Magistrate has properly appreciated the material cn record and rightly passed the impugned order, which does not warrant any interference by this Court. Hence, he prayed to dismiss the r,:vision.

6. Upon r:areful perusal of the material available on record and taking into c;onsideration the submissions made by the learned Additional Public Prosecutor, this Court is of the considered view that the learned Magistrate has rightly dismissed the discharge petition filed by the petitioner and there is no infirmity or illegality or irregularity in the impugned order, warranting interference by this Court. Accordingly, this criminal Revision case is dismissed. Pending miscellaneous applications, if any, shail stand closed. SD/. P.CH.NAGABH DEPUTY /ffRUE COPY// SECTION OFFICER ('t c
