27.04.2026

Heard learned counsel appearing for both the parties.

This application has been filed under Chapter VIII Rule P of the High Court Rules for clarification on behalf of the petitioner in respect of Judgment dated 23.03.2026.

It is contended in the instant application that with regard to paragraph No. 10 of the Judgment dated 23.03.2026 passed in WP(C) No. 166 of 2026(DO), the same needs to be clarified that respondent No.1, i.e., State of Tripura to comply the directions.

It is further contended that it should be clarified in the paragraph No. 14 of the Judgment dated 23.03.2026, that the direction in the said paragraph is required to be complied by the respondents within a reasonable time bound manner.

In view of the above, this Court feels that the aforementioned paragraphs need to be modified to clarify the above mentioned issues.

This Court directs that respondent No.1, i.e., State of Tripura shall comply the directions made in paragraph No.10 of judgment dated 23.03.2026 passed in WP(C) No. 166 of 2026 (DO).

In view of the same, paragraph Nos. 10 and 14 of the judgment dated 23.03.2026 passed in WP(C) No. 166 of 2026(DO) are modified accordingly and the same should be read as under :- Paragraph 10:- “ 10. The petitioner only has sought permission from the State- respondent for issuance of transit permit to take the cattle to its Goushala at Jharkhand from Tripura and for that purpose the petitioner has not claimed any financial assistance from the State of Tripura, respondent No.1 for the purpose of this transit of cattle. The petitioner herein has shown its voluntary willingness to accept the custody of the cattle and had undertaken comprehensive, nurturing, and attentive approach towards the cattle. The entire service rendered by the petitioner is gratuitous in nature.” Paragraph 14:- “14. Accordingly, this Court directs the respondents to issue transit permit in 01 month from today in favour of the petitioner to transport the rescued cattle from the State of Tripura to the State of Jharkhand, the Gaushala of the petitioner. Thereafter, the petitioner shall be at liberty to transport the cattle to its Gaushala at Jharkhand following due care and caution. It is made clear that in course of such transportation there shall be no violation of any of the provision under the Act, 1960 and Rules, 2017 by the respondents and their subordinates and shall co-operate and assist in shifting the cattle from Tripura to Jharkhand via Assam, Meghalaya, West Bengal and Bihar.”

In view of the above, the directions made in paragraph Nos. 10 and 14 of the judgment dated 23.03.2026 passed in WP(C) No. 166 of 2026(DO) stand clarified to the extent as indicated above.

It is made clear that this order shall form part and parcel of the order dated 23.03.2026 passed in WP(C) No. 166 of 2026 (DO).

Registry is directed to do the needful in this regard and issue a modified order.

Hence, this instant interlocutory application stands disposed of.
