Heard Mr. Debalay Bhattacharya, learned senior counsel appearing for the applicant and Mr. Raju Datta, learned PP appearing for the State.
Mr. Datta, learned PP submits that charge-sheet has recently been submitted on 03.02.2026 alongwith a prayer for custody trial of the accused-petitioner.
In that circumstances, Mr. Bhattacharya, learned senior counsel submits that the applicant begs to withdraw this bail application with a liberty to approach this Court again, if aggrieved by the order of the learned Special Judge on the petition submitted by the Investigating Officer for custody trial of the accused-petitioner and for refusal of bail on that ground.
Considered.
Liberty as sought for is granted.
The bail application is disposed of being not pressed. .
