WPMS/57/2021 Atul Gupta --Petitioner Versus State of Uttarakhand and others --Respondents

Hon’ble Manoj Kumar Tiwari, J. No representation for the petitioner. Mr. Devendra Pant, Standing Counsel for the State.

2. Petitioner has challenged order dated 04.03.2020, passed by Secretary, District Level Development Authority, Udham Singh Nagar. By the said order, petitioner was informed that he would be liable to pay sub-division charges if he develops multi-storey group housing society over his agricultural land.

3. Since by the impugned letter, petitioner was simply informed that he would be liable to pay certain amount as sub-division charges and the information is based on Government Orders as well as Building Bye-laws, applicable to concerned Development Authority, therefore, this Court do not find any scope for interference in the matter.

4. The writ petition is, accordingly, dismissed.
