1. Mr. Vinay Bhatt, learned counsel for the petitioner.

2. According to petitioner, he has moved an application for mutation, which is pending before Tehsildar, Bazpur, District Udham Singh Nagar.

3. By means of this writ petition, petitioner has sought the following reliefs:-

I. To issue suitable directions to the court of Tehsildar Bazpur, District Udham Singh Nagar to decide expeditiously the mutation case no. 30/267 of 2005-06 (Village Kishanpur Tehsil Bazpur, District Udham Singh Nagar), within the period which may be fixed by this Hon’ble Court or within a period of three months.

4. Neither concerned Tehsildar nor any other State Authority has been made party to the petition, therefore, State Counsel is right in submitting that writ petition suffers from the defect of non-joinder of necessary party.

5. In such view of the matter, the writ petition is dismissed with liberty to petitioner to file fresh petition.
