3. Petitioner has challenged order dated 01.07.2026 whereby an amount of Rs.3,46,740/- has been directed to be recovered from his gratuity in view of excess payment made to him due to incorrect determination of ACP.

4. Learned Counsel for the parties are ad idem to the fact that the controversy in question has been set at rest by this Court while passing judgment dated 14.06.2022 in WPSS No.1593 of 2021 (Balam Singh Aswal v. Managing Director and others) and batch, which was affirmed by the Division Bench in SPA No.245 of 2022 vide judgment dated 04.04.2024.

5. In view of the consensus reached between the parties, present petition is disposed of in terms of judgment dated 14.06.2022 passed in WPSS No.1593 of 2021 (Balam Singh Aswal v. Managing Director and others) and batch, which was affirmed by Division Bench in SPA No.245 of 2022 on 04.04.2024.

6. Pending application, if any, stands disposed of.
