Deepak Singh --Petitioner Versus State Legal Services Authority and others --Respondents

Hon’ble Manoj Kumar Tiwari, J. Mr. Yogesh Kumar Joshi, Advocate for the petitioner. Mr. Yashpal Singh, Advocate holding brief of Mr. Neeraj Garg, Advocate for the UPNL.

2. According to petitioner, he was engaged as Stenographer in Permanent Lok Adalat, Nainital through UPNL vide order dated 05.03.2018, passed by Chairman, Permanent Lok Adalat, Nainital. His engagement is discontinued vide order dated 11.06.2026 passed by Chairman, Permanent Lok Adalat, Nainital. The reason assigned in that order is that the vacancy on the post Personal Assistant has been supplied by regular appointment, made on the recommendation of Uttarakhand Subordinate Service Selection Commission.

3. It is contended by learned counsel for the petitioner that petitioner was appointed UKHC010141242026

2026:UHC:7353 against the post of Stenographer, therefore his engagement remains unaffected by appointment, if any, on the post of Personal Assistant. Various other contentions are raised on behalf of the petitioner.

4. Annexure 5 to the writ petition is the communication issued to petitioner by Officer on Special Duty, State Legal Service Authority. Perusal of that letter reveals that petitioner was asked to approach the Chairman, Permanent Lok Adalat, Nainital regarding his grievances.

5. Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to Chairman, Permanent Lok Adalat concerned for his re-engagement. If petitioner makes representation within 10 days, the Chairman concerned shall examine the matter and if there is any vacancy available on the post of Stenographer, then he shall sympathetically consider petitioner’s prayer for re-engagement.
