WPCRL/1666/2020

Mohd Furkan --Petitioner Versus State Ofuttarakhand --Respondent

Hon'ble Alok Mahra, J.

Mr. S.K. Mandal, learned counsel for the petitioner.

2. Mr. Rakesh Joshi, learned A.G.A. along with Mr. Manoj Bhatt, learned Brief Holder for the State.

3. Learned State Counsel, on the basis of written instructions received from the Investigating Officer, submits that during the pendency of the present criminal writ petition, the investigation has been concluded, a charge-sheet has been submitted before the competent court, and the learned court concerned has taken cognizance of the offences against the petitioner. It is, therefore, contended that the principal relief sought in the present writ petition, no longer survives for consideration, and the writ petition has consequently become infructuous.

4. In view of the subsequent development, namely, submission of the charge-sheet and taking of cognizance by the competent court, this Court is of the opinion that the relief claimed in the present criminal writ

UKHC010100872020

2026:UHC:6812 petition no longer survives at this stage. Accordingly, the present criminal writ petition is dismissed as having become infructuous.

5. Pending application(s), if any, shall also stand disposed of.
