Learned counsel for the petitioner submits that, upon receipt of the notice under Section 35(3) of the B.N.S.S., 2023, the petitioner shall appear before the Investigating Officer on the date and time specified therein and shall extend full cooperation in the investigation. It is further submitted that the petitioner shall not evade the process of law or attempt to influence the witnesses or tamper with the evidence.

6. In view of the aforesaid submissions and without expressing any opinion on the merits of the case, it is directed that the Investigating Officer shall serve upon the petitioner a notice under Section 35(3) of the B.N.S.S., 2023, if so required in law. Till such notice is duly served to the petitioner, no coercive action shall be taken against the petitioner in connection with the aforesaid F.I.R.

7. The writ petition is, accordingly, disposed of.
